Using fake divorce papers with husband to get married to someone else
(Baonghean.vn) - To achieve the goal of registering her marriage with someone else, Hoe went online to buy a decision recognizing a consensual divorce and her agreement with her husband, Truong Van Ngoc, for 5 million VND.
On September 29, the People's Court of Quy Hop district held a first-instance trial of the criminal case against Nguyen Thi Hoe (born in 1992), residing in Phuc Tien village, Chau Tien commune (Quy Hop) for the crime of "using fake seals or documents of organizations".
According to the investigation results, on August 20, 2020, Mr. Nguyen Van Thang - the biological father of defendant Nguyen Thi Hoe brought the decision recognizing the consensual divorce and the agreement of the parties No. 56/2020/QDST-HNGD, dated August 8, 2020, signed by Judge Le Xuan Dieu and a red image with the content "QUI HOP DISTRICT PEOPLE'S COURT, NGHE AN TABLE" to the People's Committee of Chau Tien commune, Quy Hop district, requesting a certificate of marital status.
After being granted the certificate, due to an error in the month of birth, on August 24, 2020, Mr. Thang came to request a re-issue of the certificate. The staff of Chau Tien Commune People's Committee discovered and suspected that Decision No. 56 above was fake, so they kept the above documents to conduct initial preliminary verification and reported the incident to the People's Court of Quy Hop District.

Considering that the above decision is fake, because on August 8, 2020, the People's Court of Quy Hop district did not issue Decision No. 56/2020/QDST-HNGD and at that time the People's Court of Quy Hop district did not have a judge named Le Xuan Dieu, so the People's Court of Quy Hop district requested the Investigation Police Agency - Quy Hop District Police to conduct an investigation to verify and handle the case.
At the investigation agency, Hoe confessed that Hoe and Truong Van Ngoc were working together.legal spousesHowever, since 2014, Mr. Ngoc has not been present in the locality and his whereabouts are unknown. Hoe filed for divorce from Mr. Ngoc, but the People's Court of Quy Hop district could not proceed with the settlement.
On August 13, 2020, Hoe withdrew his divorce petition, so the Court decided to suspend the settlement of the civil case. In order to achieve the purpose of registering his marriage with someone else, Hoe went online to buy a decision recognizing a consensual divorce and the agreement of the parties for 5 million VND.
On August 18, 2020, Hoe asked Mr. Thang (his biological father) to receive the fake Decision No. 56 that he had purchased. Based on that, the People's Committee of Chau Tien Commune issued a certificate of marital status to Hoe as being single. Because the certificate had an error in the month of birth, Hoe could not complete the marriage registration procedure. On August 24, 2020, Mr. Thang came to request a re-issue of the certificate for Hoe, but the staff of the People's Committee of Chau Tien Commune confiscated the documents.
In the Conclusion of the appraisal No. 412 dated October 22, 2020 of the Criminal Techniques Department of Nghe An Police, it was stated that: The seal with the symbol A was created by the color inkjet printing method. The letters in the round seal with the symbol A compared with the round seal on the comparison sample document with the symbol M were not stamped by the same seal.
After considering and weighing the nature and level of danger to society of the crime, the defendants' personal background, the mitigating and aggravating circumstances of the defendants' criminal responsibility, the Trial Panel decided to sentence defendant Nguyen Thi Hoe to 9 months in prison with a suspended sentence for the crime of "using fake seals or documents of agencies and organizations" as prescribed in Clause 1, Article 314 of the Penal Code.
