Addict beats younger brother, chases away mother, injures commune police
(Baonghean.vn) - After beating his younger brother and chasing his mother away, his family reported the incident and asked for help in resolving the issue. Tuan also beat the police when they came down to invite him to come in for questioning.
On the afternoon of May 24, 2022, Tan Ky District People's Court tried the criminal case against Dang Van Tuan (born in 1986), residing in Nguyen Trai hamlet, Nghia Hanh commune, Tan Ky district, for the crime of "intentionally causing injury".
On the morning of December 22, 2021, Ms. Dang Thi Thanh (Tuan's younger sister) was at home when Tuan beat her. Tuan chased and beat his biological mother but failed. In the afternoon of the same day, Ms. Dang Thi Thanh went to Tan Ky District People's Court to report the incident and asked for support to resolve the matter.
After receiving the news, Tan Ky District People's Court informed the source of information to the Investigation Police Agency. Tan Ky District Police directed Nghia Hanh Commune Police, Tan Ky District to conduct inspection and verification of the source of information for handling according to the provisions of law.

At about 3:30 p.m. the same day, a working group of Nghia Hanh Commune Police, Tan Ky District, led by Nguyen Thanh Binh, the Commune Police Chief, Nguyen Chau Thiep and Vo Van Trong, all of whom were regular police officers, dressed in People's Police uniforms, brought an invitation to Dang Van Tuan's house. At about 4:15 p.m., when the working group arrived at the road in front of Dang Van Tuan's house, they saw Dang Van Tuan holding a knife to cut a bamboo tree (rattan) in the corner of the garden about 20 meters from the gate, so the working group entered the gate. Dang Van Tuan, holding a knife in his right hand and a piece of bamboo in his left hand, stood in front of the gate, cursing, threatening, obstructing and not allowing the working group to enter the gate.
Seeing that, Mr. Nguyen Chau Thiep asked Dang Van Tuan to put down the knife to talk and give the invitation to Dang Van Tuan, but Tuan did not comply and continued to curse, threatened with a knife, prevented, chased the working group out of the gate, and used a piece of bamboo to hit Mr. Vo Van Trong but missed.
Seeing that Dang Van Tuan was uncooperative, defiant and aggressive, the working group retreated. Dang Van Tuan threw a knife at the working group and hit the back of Nguyen Thanh Binh's left hand, injuring Binh.
Realizing that Dang Van Tuan's behavior had signs of crime, the working group of Nghia Hanh Commune Police, Tan Ky District, made a record of the arrest of the offender, and Nguyen Thanh Binh was taken for treatment by everyone.
Forensic examination conclusion on injuries No. 426/TTPY dated December 29, 2021 of Nghe An Provincial Forensic Center concluded: The current rate of bodily injury caused by injuries is 10%.
The supplementary forensic examination conclusion on injuries No. 162/TTPY dated April 13, 2022 of the Nghe An Provincial Forensic Center concluded: The current rate of bodily injury caused by injuries is 18%.
During the investigation, Dang Van Tuan showed signs of mental illness, so an assessment was requested. The conclusion of the forensic psychiatric assessment No. 02/KLGD dated March 28, 2022 of the North Central Forensic Psychiatric Institute concluded: At the time after committing the crime and at the time of assessment, Dang Van Tuan suffered from mental and behavioral disorders due to the use of hallucinogenic substances with Addiction Syndrome, currently in withdrawal, but in a protected environment, according to the 10th International Classification of Diseases in 1992 (ICD) with the disease code: F16.21.
At the above mentioned times, Dang Van Tuan was capable of perceiving and controlling his actions. During the investigation, Mr. Nguyen Thanh Binh requested Dang Van Tuan to compensate for health damage in the amount of 33 million VND. To date, Dang Van Tuan has not paid any compensation.
At the end of the trial, the panel sentenced Dang Van Tuan to 3 years in prison.
