Director of Van Hoa Company arrested for labor export fraud

On May 12, the Economic Police Department of Da Nang City Police announced that it had just issued a decision to prosecute and temporarily detain two suspects in a labor export fraud ring that appropriated large sums of money from victims.

Previously, through the work of grasping the situation in the field of labor and employment and handling citizens' complaints of crimes, the Economic Police Department of Da Nang Police discovered a number of enterprises operating in the field of labor export with signs of violating the law, including Van Hoa Import-Export Service Company Limited (headquartered in Ho Chi Minh City).

Specifically, this enterprise provided false information about labor export programs under labor cooperation programs between the Vietnamese government and governments of other countries, recruiting labor in simple employment fields (agriculture, restaurant and hotel services) in developed countries such as the US, Canada, Australia, New Zealand, Greece, etc. to attract customers in many localities across the country, including some customers in Da Nang.

The Da Nang Police Investigation Agency issued a decision to prosecute and temporarily detain Pham Van Hoa.

Initial investigation results show that in December 2021, Pham Van Hoa (born in 1980, residing in Ba Ria-Vung Tau province) went to Ho Chi Minh City to establish Van Hoa Import-Export Service Company Limited to provide employment services and held the position of director. Although not licensed by the Ministry of Labor, War Invalids and Social Affairs to operate a business providing services to send Vietnamese workers abroad, Hoa used the company's legal entity to organize recruitment activities and promised to send Vietnamese workers to work as manual laborers on Australian farms.

Hoa self-issued documents on the company's labor export program to Australia and organized employees and collaborators to consult, receive, screen applications and collect money from customers in need of labor export.

From January 2023, Hoa authorized Le Van Hung (born in 1976, residing in Ho Chi Minh City) to receive, screen applications and collect money from customers. Hung assigned Nguyen Nhu Phap (born in 1974, residing in Binh Thuan province) to participate in consulting and finding more customers in the Central region.

Although he was not an employee or authorized collaborator of the Cultural Company, and did not understand or master the legal regulations on services to send Vietnamese workers to work abroad, Phap rented a house in Son Tra district, Da Nang city to open a "Branch Office of Cultural Import-Export Service Company Limited in Da Nang" and claimed to be the Branch Manager of the company.

Phap provided false information to customers and forged the seal and commitment documents of Van Hoa Company to receive more than 1.9 billion VND from many people with the promise to take care of the procedures to send them to work in Australia. After receiving the money, Hoa and Phap did not carry out any activities related to labor export for customers but appropriated and used it for personal purposes.

During the investigation, the Police Department also clearly identified the role of Pham Van Hoa in the above case. Along with the prosecution and temporary detention of Pham Van Hoa and Nguyen Nhu Phap, the Economic Police Department of Da Nang City Police is investigating and clarifying the roles and responsibilities of a number of other related individuals.
