Director of Department of Natural Resources and Environment: Draft land price list submitted to Provincial People's Council is reasonable

The issue that has recently attracted public attention continued to be raised by delegates of the Provincial People's Council at the group discussion session on the afternoon of December 10.

With the responsibility of the advisory agency in the issue of price construction, at the discussion session in the hall this morning, Director of the Department of Natural Resources and Environment Vo Duy Viet explained specifically about the issue of land price adjustment presented at the 12th session, decided by the Provincial People's Council.

Delegate Vo Duy Viet affirmed that the draft land price list for the period 2020 - 2024 developed by the Provincial People's Committee and submitted to this session is based on the land price framework issued by the Government and the practical investigation of market fluctuations, and at the same time, surveying the land price list of two neighboring provinces. Therefore, the draft land price list submitted to the Provincial People's Council this time is reasonable.

Delegate Vo Duy Viet also explained that the authority to develop the land price framework belongs to the Government and the authority of the Provincial People's Council to pass the Resolution on land price list as a basis for the Provincial People's Committee to approve specific price lists for each area, route, land type, and land use purpose. Based on the resolution on land price list for the period 2020 - 2024 approved by the Provincial People's Council, every year, based on the actual market fluctuations of about 20%, the Provincial People's Committee continues to propose for the Provincial People's Council to decide on adjustments.

Responding to the concerns and worries of the business community and many delegates of the Provincial People's Council regarding high land prices in industrial parks and industrial clusters, proposing research and appropriate adjustments to ensure the harmony of interests between enterprises and the state, creating stimulus to attract investment, the Director of the Department of Natural Resources and Environment affirmed: Land prices in these two areas have not increased compared to the land price list for the period 2015 - 2019.

Director Vo Duy Viet also added that, based on the People's Council resolution approving the land price list for the period 2020 - 2024, the authority of the Provincial People's Committee decides the land price list for each area and route.

The purpose of building the land price list of the Provincial People's Committee is to serve 7 contents, such as calculating land use fees when the State recognizes land use rights within the limit; converting land use purposes; calculating land tax; calculating fees and charges in management, land use tax, fines for administrative violations in the land sector...

In addition, the authority of the Provincial People's Committee also decides on specific land prices for 5 cases according to the provisions of the Land Law, such as land allocation and land lease prices for each project, construction, and area; calculating compensation when the State reclaims land...

Draft Resolution of the Provincial People's Council on approving the land price list in Nghe An province, period from January 1, 2020 to December 31, 2024:

1. Price list of residential land, rice-growing land, annual crop land, perennial crop land, production forest land, aquaculture land, salt-making land in 21 districts, cities and towns (according to the appendix attached to this Resolution).

2. Land price list for non-agricultural production and business (excluding commercial and service land): Equal to 50% of the price of adjacent residential land (same location) or residential land with equivalent location (same route and infrastructure), but not lower than the minimum price as prescribed by the Government.

3. Commercial and service land price list: Equal to 55% of the price of adjacent residential land (same location) or residential land with equivalent location (same route and infrastructure) but not lower than the minimum price as prescribed by the Government.

4. Land price list for production and business purposes serving mineral exploitation purposes: Equal to 100% of the price of adjacent residential land or equivalent location but not exceeding the maximum price of non-agricultural production and business land that is not commercial or service land according to Government regulations.

5. Price list of other types of land: Based on the price of residential land, production forest land, and agricultural land types specified in the price list to determine the price.

6. For residential land lots and non-agricultural production and business land adjacent to at least 02 roads, based on the price list specified in Clause 1 and Clause 2 of this Article, the price is also determined as follows:

a) The price increase is at least 10% compared to other adjacent plots on the same route with higher prices.

b) For lots and plots of land with a depth of more than 30m from the road construction boundary, in addition to determining the corner lot price as above, the price of the remaining land area is determined as follows:

- Determine the price of the first 20m area along the road (location 1) in order from the road with the highest price to the road with the lowest price.

- The remaining area is determined according to the line with the highest price using the classification method in Clause 7 of this Article.

7. For residential land plots, commercial land, service land and non-agricultural production and business land that is not commercial or service land with a depth of more than 30m from the road construction boundary, the land price is determined according to the layering method to ensure that the price of the last layer of land is not lower than the land price of adjacent plots with equivalent locations, specifically:

a) The first 20m deep area along the road (location 1): Price is 100% of the price specified in the land price list;

b) The area from 20m to 40m deep: The price is 60% of the price specified in Point a of this Clause;

c) The area from 40m to 60m deep: The price is 40% of the price specified in Point a of this Clause;

d) The area from 60m to the next 200m deep: The price is 20% of the price specified in Point a of this Clause;

g) The area from 200m to the next 500m deep: The price is equal to 7% of the price specified in Point a of this Clause;

h) The remaining area deeper than 500m: Price is 3% of the price specified in Point a of this Clause.
