Director of the Department of Justice let his wife be the head of the notary office

According to the Law on Anti-Corruption, heads of state are not allowed to let their spouses, parents, or children do business within the scope of their direct management.

According to the reflection of some officials and civil servants of Khanh Hoa province, on February 25, 2013, Mr. Le Van Ha, Director of the Department of Justice of Khanh Hoa province, submitted a request to the Provincial People's Committee to allow the establishment of Hoang Long Notary Office. This is the office registered under the name of Ms. Pham Thi My Phung (Mr. Ha's wife).

After that, the Provincial People's Committee issued a decision to allow the establishment of Hoang Long Office of Legal Aid. On March 22, 2013, the Director of the Department of Justice of Khanh Hoa Province issued a certificate of registration of operation for Hoang Long Office of Legal Aid, with his wife as the head of the office. This Office of Legal Aid has been operating since mid-April 2013 until now.

In 2013, Mr. Nguyen Xuan Thanh, a former official of the Department of Justice of Khanh Hoa province, sent a petition to central agencies and Khanh Hoa province to clarify some of Mr. Le Van Ha's activities, including allowing his wife to establish the Office of the People's Procuracy.

Mr. Thanh said: “I have pointed out that the director of the Department of Justice's act of allowing his wife to establish and operate notary and certification services in his name is a violation of Article 37 of the Anti-Corruption Law and Regulation No. 47/QD-TW on what party members are not allowed to do. At that time, many authorities intervened but in the end, there was no conclusion. Meanwhile, the fact that Mr. Ha still allowed his wife to operate services in the field under his direct management has made many people angry.”

Three years of processing without conclusion

We went to the Khanh Hoa Province Department of Justice, contacted by phone many times and registered to work with Director Le Van Ha to know his opinion on the above incident but all had no results. The reporter texted to present the content of the registration to work, Mr. Ha also did not respond.

An official of the Khanh Hoa Provincial Party Committee's Inspection Commission confirmed that in 2013, the agency received a number of complaints related to Mr. Le Van Ha, including the matter of allowing his wife to establish and operate a VPCC. However, the official said that the reason why the Provincial Party Committee's Inspection Commission has not yet concluded this matter is unclear.

An inspector of Khanh Hoa province said that from September to November 2013, the provincial inspectorate participated in verifying and clarifying this issue. “At that time, after comparing the regulations, there were many opinions that the director of the Department of Justice had signs of violating the Law on Anti-Corruption. However, because the Provincial Party Committee's Inspection Commission was verifying the contents of the accusations related to Mr. Ha, the leaders agreed to let the Inspection Commission make a conclusion,” said the inspector.

Assessing the case, this official stated: “According to the provisions of law, the Department of Justice is the state management agency for notary organizations. The Department of Justice is responsible to the provincial People's Committee for implementing state management of notary in the locality, performing the tasks and powers prescribed in the Law on Notary and other relevant legal documents.

The Department of Justice is responsible for assisting the provincial People's Committee in conducting inspections of notary organizations and activities in the locality. The Director of the Department of Justice is responsible for inspecting and supervising the implementation of the code of ethics for notaries and notary organizations within the locality under his management. With such regulations, the director of the Department of Justice of Khanh Hoa province allowing his wife to establish a notary office is a violation of Article 37 of the Law on Anti-Corruption.

Mr. Nguyen Chuyen, Chairman of the Inspection Committee (IC) of Khanh Hoa Provincial Party Committee, promised to respond later about this matter.

Former Director of the Department of Culture, Sports and Tourism of Khanh Hoa province violated the Law on Anti-Corruption

Explaining at the meeting of the Khanh Hoa Provincial People's Council on August 11, the Provincial People's Committee affirmed that Mr. Truong Dang Tuyen, former Director of the Department of Culture, Sports and Tourism, violated the provisions of the Law on Anti-Corruption. Specifically, while still in office as Director of the Department of Culture, Sports and Tourism, Mr. Tuyen let his wife, Ms. Huynh Thi Minh Thanh, establish Silent Bay Trading and Tourism Company Limited, and his son, Truong Dang Vu Thuy, contributed capital and later became the director of this company. Mr. Tuyen's wife's company operates in tourism and travel services - a field directly managed by him. Currently, the Provincial People's Committee is assigning relevant authorities to continue clarifying and handling the matter.

The conclusion of the Khanh Hoa Provincial People's Committee regarding Mr. Truong Dang Tuyen was made after a number of press agencies discovered and reported that Mr. Tuyen allowed his family members to do international tourism business - the field that he directly managed while in office. Also after the newspaper reported, voters petitioned the Provincial People's Committee to inspect and handle responsibility for Mr. Tuyen.

Mr. Tran Quang Binh, Deputy Director of the Department of Justice of Khanh Hoa province, said that up to now, the wife of Mr. Le Van Ha, Director of the Department of Justice of Khanh Hoa province, is still the head of Hoang Long Notary Office. In response to the reporter's question: "As the person in charge of the notary field, what is your opinion on this case?", Mr. Binh said: "This is a sensitive matter! I will answer later!".
