Comments on the draft Law in Nghe An: Need specific regulations to avoid duplication and overlap
(Baonghean.vn) - On the afternoon of August 14, implementing the direction of the National Assembly Standing Committee, the Provincial National Assembly Delegation held a Conference to collect comments on the draft Law on Vietnam Coast Guard and the draft Law on Protection of State Secrets to be submitted to the National Assembly for consideration and approval at the 6th session of the 14th National Assembly.
Based on the analysis of scientific, legal and practical foundations, the conference delegates gave 8 comments, deeply dissecting many different aspects of the draft Laws.

Regarding the draft Law on Vietnam Coast Guard, this draft was discussed and commented on by National Assembly deputies at the 5th session of the 14th National Assembly. Accordingly, the draft Law consists of 8 chapters and 48 articles stipulating the position, functions, tasks, powers, principles of organization and operation of the Vietnam Coast Guard; ensuring the regime and policies for the Vietnam Coast Guard; and the responsibilities of relevant agencies, organizations and individuals. Based on the opinions of National Assembly deputies, the National Assembly Standing Committee directed the review, revision and continued to collect public opinions.

At the conference to collect opinions organized by the Provincial National Assembly Delegation, some opinions suggested that it is necessary to clearly define the authority and scope of operations of the Coast Guard, avoiding overlap with patrol and control forces in the same sea area; and proposed to identify violations as the basis for exercising the authority of the Vietnam Coast Guard. Many opinions also mentioned reviewing and strictly regulating cases of shooting by the Vietnam Coast Guard to ensure feasibility. In addition, it is also necessary to ensure the operations, regimes and policies for the Coast Guard.
Regarding the draft Law on Protection of State Secrets, this draft includes 5 chapters and 34 articles, regulating state secrets, state secret protection activities and responsibilities of relevant agencies, organizations and individuals.
Some delegates attending the meeting proposed strict regulations on copying and photographing confidential documents; limiting the number of people authorized to allow copying and photographing state secrets; clarifying the authority and providing more specific regulations for some subjects in socio-political organizations, local agencies and organizations.

Besides, many opinions also said that the content between chapters and articles still overlaps, suggesting that it needs to be researched and edited; the terminology also needs to be precise and strict when the Law is promulgated.
On behalf of the Provincial National Assembly Delegation, Comrade Tran Van Mao acknowledged the comments and suggestions. On that basis, the Delegation will synthesize and give comments at the upcoming National Assembly session.
