Comments to improve the draft Decree detailing regulations on rice cultivation land.

On the afternoon of June 18th, in Hanoi, under the chairmanship of Deputy Prime Minister Tran Hong Ha, the Government held an online meeting to discuss and agree on the contents to finalize the draft Decree detailing regulations on rice cultivation land.

Nghe An participated in the meeting under the chairmanship of Comrade Nguyen Van De - Vice Chairman of the Provincial People's Committee.

The Decree detailing regulations on rice-growing land was developed by the Ministry of Agriculture and Rural Development in coordination with relevant ministries, sectors, and localities, aiming to complete the legal framework for the management and use of rice-growing land in accordance with the Land Law of 2024 and the Crop Production Law of 2018.

Over the past period, in order to implement the Land Law of 2013 and the Crop Production Law of 2018, the Government has issued three Decrees regulating matters related to the management and use of rice cultivation land, including: Decree No. 35 of 2015, Decree No. 62 of 2019, and Decree No. 94 of 2019.

This has created a robust, feasible, and comprehensive legal framework for managing and utilizing rice-growing land, facilitating flexible crop restructuring on rice land. However, during implementation, some aspects have become inadequate and no longer relevant to current practices.

The Decree detailing regulations on rice-growing land was developed to improve the legal framework for managing and using rice-growing land in accordance with the Land Law of 2024 and the Crop Production Law of 2018. This aims to address existing problems and shortcomings, ensure the legitimate rights and interests of organizations and individuals, and enhance the effectiveness and efficiency of state management of rice-growing land.

The Decree stipulates provisions on the management and use of rice-growing land, including: Regulations on the conversion of crop and livestock structures on rice-growing land; Conditions for constructing facilities directly serving agricultural production on rice-growing land; Policies to support the protection and development of rice-growing land; and transitional provisions for cases implemented before the effective date of this Decree, such as support policies and plans for the use of topsoil.

At the meeting, representatives from central and local ministries and agencies contributed many ideas to improve the draft Decree to meet practical requirements.

On this occasion, Nghe An province also contributed several opinions to the draft Decree, such as: proposing adjustments to include additional subjects in the regulations on the dossiers of organizations and individuals who need to build structures directly serving agricultural production on rice-growing land; draft regulations on the dossier and procedures for appraising the plan for using the topsoil layer; sanctions for violations of the plan for using the topsoil layer; and specific regulations on criteria for using the topsoil layer in accordance with the land use planning and purpose.

The province also proposed specific regulations on the level of financial support for organizations and individuals researching and developing new plant varieties, and using legally obtained new plant varieties for production on converted land...

Concluding the meeting, Deputy Prime Minister Tran Hong Ha stated that in order to protect rice-growing land, farmers must be able to make a good living from rice farming. The draft Decree must specify detailed provisions to meet this requirement, creating conditions for farmers to stay on their fields, thereby making a significant contribution to ensuring food security, stability, and socio-economic development in the area.

Deputy Prime Minister Tran Hong Ha requested the Ministry of Agriculture and Rural Development to incorporate the feedback received and coordinate efforts to finalize the draft for submission to the Government for approval.
