Contribute to complete the draft Decree detailing regulations on rice-growing land

The Decree is designed to complete the legal basis for management and use of rice-growing land according to the provisions of the 2024 Land Law and the 2018 Law on Cultivation.

On the afternoon of June 18, in Hanoi, chaired by Deputy Prime Minister Tran Hong Ha, the Government held an online meeting to discuss and agree on contents to complete the draft Decree detailing regulations on rice-growing land.

The Decree detailing regulations on rice-growing land is chaired by the Ministry of Agriculture and Rural Development, in coordination with relevant ministries, branches and localities, to perfect the legal basis for management and use of rice-growing land according to the provisions of the 2024 Land Law and the 2018 Law on Cultivation.

Recently, to implement the 2013 Land Law and the 2018 Law on Cultivation, the Government has issued 03 Decrees regulating contents related to the management and use of rice-growing land, including: Decree No. 35 of 2015, Decree 62 of 2019 and Decree No. 94 of 2019.

This has created a strict, feasible and complete legal corridor for the management and use of rice-growing land, facilitating flexible conversion of crop structures on rice-growing land. However, during the implementation process, some contents have arisen with inadequacies and are no longer suitable for practice.

The Decree detailing regulations on rice-growing land is developed to complete the legal basis for management and use of rice-growing land according to the provisions of the 2024 Land Law and the 2018 Law on Cultivation. Thereby, overcoming difficulties and shortcomings, ensuring the legitimate rights and interests of organizations and individuals; improving the effectiveness and efficiency of state management of rice-growing land.

The Decree stipulates the contents on management and use of rice-growing land such as: Regulations on conversion of crop and livestock structure on rice-growing land; Conditions for construction of works directly serving agricultural production on rice-growing land; Support policies for protection and development of rice-growing land; Regulations on transitional provisions for cases implemented before the effective date of this Decree such as support policies, development of plans for use of topsoil, etc.

At the meeting, representatives of central and local ministries and branches contributed many ideas to perfect the draft Decree to meet practical requirements.

On this occasion, Nghe An province also contributed some comments to the draft Decree, such as: Proposing to adjust and add more subjects in the content of regulations on dossiers of organizations and individuals who need to build works directly serving agricultural production on rice-growing land; Draft regulations on dossiers and procedures for appraising plans for using topsoil; Sanctions for violations of plans for using topsoil; Specific regulations on criteria for using topsoil in accordance with planning and land use purposes.

The province also proposed specific regulations on the level of funding support for organizations and individuals researching, selecting and creating new plant varieties, and using new legal plant varieties for production on converted areas...

Concluding the meeting, Deputy Prime Minister Tran Hong Ha said that in order to protect rice-growing land, farmers must make a good living from rice cultivation. The draft Decree must specify detailed provisions to meet this requirement, creating conditions for people to stay in their fields, thereby making an important contribution to ensuring food security, stabilizing and developing the local economy and society.

Deputy Prime Minister Tran Hong Ha requested the Ministry of Agriculture and Rural Development to absorb comments and coordinate to complete the draft for submission to the Government for approval.
