Comments on the Draft Law on Cooperatives

On April 17th, in Vinh City, the Nghe An Provincial Cooperative Union held a conference to provide feedback on the draft revised Law on Cooperatives. Attending the conference were representatives from the Vietnam Cooperative Union, the Cooperative Department of the Ministry of Planning and Investment, the Nghe An Provincial Delegation of the National Assembly, the Provincial People's Council, and representatives from various departments, agencies, and cooperatives in the province.

(Baonghean.vn) -On April 17th, in Vinh City, the Nghe An Provincial Cooperative Union held a conference to provide feedback on the draft revised Law on Cooperatives. Attending the conference were representatives from the Vietnam Cooperative Union, the Cooperative Department of the Ministry of Planning and Investment, the Nghe An Provincial Delegation of the National Assembly, the Provincial People's Council, and representatives from various departments, agencies, and cooperatives in the province.



Representatives from cooperatives participated and contributed their opinions at the conference.

At the conference, the Provincial Cooperative Union and its member cooperatives focused their efforts on discussing and contributing ideas to the draft revised Law on Cooperatives. Specifically, Article 8, Section 4, concerning the economic linkage of members with cooperatives and cooperative unions, needs to be amended to align with Article 49, Chapter V.

Specifically: members are entitled to remaining income based on their level of product and service usage and capital contribution. Article 9, Section 1, is proposed to be revised: only according to the charter and business plan of the cooperative or cooperative union. Government guidelines should not be included (applicable to Section 1, Clause g, Article 17). Article 10, Section 7: This regulation is inconsistent with the accounting and statistical system and the method of calculating production costs, business prices, and financial costs. If this income can be calculated separately, it should be stipulated in the accounting and income distribution method of the cooperative's charter without amending the Cooperative Law. In addition, there are other suggestions for amending and supplementing several chapters and articles, etc.

At the conference, the Provincial Cooperative Union and its member cooperatives also requested the Provincial National Assembly Delegation to study the contributions and feedback received in order to discuss and approve the amended Cooperative Law at the upcoming 13th National Assembly sessions. Simultaneously, while monitoring production, business, and service activities, implementing the Cooperative Law, and strengthening cooperative organizations in accordance with the Central Party and Government's resolutions on the collective economic sector and various types of cooperatives in Nghe An province, they requested supervisory and inspection activities with relevant sectors and localities regarding the implementation of tasks related to the development of the collective economy (with cooperatives as the core), aiming to further develop the province's collective economic sector.
