The draft amendments to the 1992 Constitution have been officially put to a referendum for three months. This is an opportunity for all citizens to exercise their rights and obligations to contribute their opinions to the draft so that the Constitution truly reflects the wisdom of the entire nation.




The 1992 Constitution, the constitution of the early period of reform, is the fundamental law of our state. Over the 20 years of implementing the 1992 Constitution, our country has achieved tremendous achievements of historical significance. To date, our country has undergone many changes in the context of a rapidly changing, complex, and profound international situation. The 2011 supplementary and development program for building the country during the transitional period to socialism and other documents of the 11th National Congress of the Communist Party of Vietnam have clearly defined the goals and orientations for national development in the new revolutionary period, aiming to build a prosperous, strong, democratic, just, and civilized Vietnam.

To implement the Resolution of the 11th National Congress of the Communist Party of Vietnam on the policy of researching, amending, and supplementing the 1992 Constitution, which was amended and supplemented in 2001 to suit the new situation, on August 6, 2011, the 13th National Assembly issued Resolution No. 06 on amending and supplementing the 1992 Constitution and establishing the Constitutional Amendment Committee. After more than a year of implementation, the Constitutional Amendment Committee organized a review of the implementation of the 1992 Constitution and drafted the revised Constitution.

On January 2nd, the Committee for Drafting Amendments to the 1992 Constitution officially published the draft amendments to the 1992 Constitution through mass media to gather widespread public opinion. The draft amendments to the 1992 Constitution inherit the scientific values ​​regarding content and constitutional drafting techniques from the 1946, 1959, 1980, and 1992 Constitutions. The draft, comprising 11 chapters and 124 articles, includes numerous amendments, additions, and some new content compared to the current Constitution.

This draft for public consultation has clarified and fully explained the leading role and position of the Party, the ideology of national unity, and the viewpoint on people's sovereignty, oriented towards the people exercising state power through direct democracy and representative democracy via the National Assembly, People's Councils, and other state agencies. It also supplements and develops the principle that "state power is unified, with a division of labor, coordination, and control among state agencies in the exercise of legislative, executive, and judicial powers" in the spirit of the Party's platform.

Regarding human rights and the fundamental rights and obligations of citizens, the draft clarifies the content of human rights and citizens' rights, the responsibilities of the State and society in respecting, guaranteeing, and protecting human rights and citizens' rights; it also adds several new rights resulting from the 25 years of reform in our country, in accordance with international human rights treaties to which the Socialist Republic of Vietnam is a signatory.

Regarding the economic, social, cultural, educational, scientific, technological, and environmental aspects, the draft has institutionalized the Party's viewpoints as defined in the Platform on economic, cultural, social, educational, scientific, technological development and environmental protection; it further clarifies the nature and economic model, the State's management role in the socialist-oriented market economy, the ownership regime, and the right to freedom of business…

Regarding national defense, the draft affirms and deepens the core role of the people's armed forces in the cause of national defense, and the connection between foreign affairs and national defense and security in building the country and protecting independence, sovereignty, unity, and territorial integrity.

Considered the fundamental law, the amendment of the Constitution is a momentous issue for every nation. In fact, the Constitutions of Vietnam in 1959, 1980, 1992, and the 2001 amendments and supplements were all subject to public consultation. This consultation process provides an opportunity for all citizens to exercise their right to self-governance and their sense of responsibility in contributing their opinions to the draft, ensuring that the Constitution truly reflects the collective wisdom of the entire nation.
