Instructions for transferring salary of civil servants and public employees when changing jobs
The Ministry of Home Affairs has just issued Circular 13/2018/TT-BNV amending Clause 8, Section III, Circular 79/2005/TT-BNV guiding salary changes for cadres, civil servants, and public employees when changing jobs and cases of transfer from the armed forces, cryptography and state-owned companies to work in state agencies and state-owned service units.

Accordingly, the Circular amends Clause 8, Section III, Circular No. 79/2005/TT-BNV as follows:
“8. The person holding a title or position at an enterprise that is a single-member limited liability company in which the State holds 100% of the charter capital or the person representing the State capital holding a management position at an enterprise (collectively referred to as the person holding the management position of a corporation, general company, or company) is elected, recruited, or appointed in accordance with the provisions of law to work as a cadre, civil servant, or public employee in State agencies or public service units. If under the management of the Politburo or the Secretariat, the salary shall be arranged according to the instructions of the Central Organization Committee; in the remaining cases, salary shall be arranged as follows:
a) Salary classification for senior expert or civil servant, professional title of civil servant equivalent to senior expert (collectively referred to as senior expert or equivalent):
Those who have had a period of time in the senior specialist salary scale or equivalent or meet all 3 of the following conditions will be considered for the senior specialist salary scale or equivalent: 1- Currently holding the position of manager of a corporation or general company elected, recruited, appointed to a position in a central agency with a leadership allowance coefficient of 1.0 or higher or a position in a province or centrally-run city with a leadership allowance coefficient of 0.9 or higher; 2- Have paid compulsory social insurance for a job requiring a university degree for at least 16 years (if there is a period of interruption without receiving a one-time social insurance benefit, it will be accumulated), including the time holding the position of manager of a corporation, general company, or company for at least 10 years; 3 - The salary coefficient for social insurance contributions of the management position of the group or corporation according to the Government's regulations, minus the leadership position allowance coefficient of the position expected to be elected, recruited, or appointed, is equal to or greater than the salary coefficient of level 1 of the senior specialist rank or equivalent.
Salary arrangement is carried out as follows: In case there is enough time to arrange salary at the senior specialist level or equivalent, then based on the time of enjoying the salary level at that senior specialist level or equivalent and the time holding the management position of the group, corporation, company, to arrange to a higher salary level or calculate the seniority allowance exceeding the salary scale (if any) according to the regular salary increase regime, the seniority allowance exceeding the salary scale of the senior specialist level or equivalent...
b) Salary classification of senior specialist or civil servant, professional title of civil servant equivalent to senior specialist (collectively referred to as senior specialist or equivalent):
Those who have had a period of time of salary classification at the senior specialist level or equivalent or meet all 3 of the following conditions will be considered for salary classification at the senior specialist level or equivalent: 1- Currently holding the position of manager of a corporation, general corporation, or company elected, recruited, or appointed to a position in a central agency with a leadership allowance coefficient of 0.8 or higher or a position in a province or centrally-run city with a leadership allowance coefficient of 0.7 or higher; 2- Have paid compulsory social insurance for a job requiring a university degree for at least 10 years (if there is a period of interruption without receiving a one-time insurance benefit, it will be accumulated), including at least 5 years of holding the position of manager of a corporation, general corporation, or company; 3- The salary coefficient for social insurance contributions of the management position of a corporation, general company, or company according to Government regulations, minus the leadership position allowance coefficient of the position expected to be elected, recruited, or appointed, is equal to or greater than the salary coefficient of level 1 of the senior specialist rank or equivalent.
Salary arrangement is carried out as follows: In case there has been a period of salary arrangement at the senior specialist level or equivalent, the time of enjoying the salary level at that senior specialist level or equivalent and the time holding the management position of the group, corporation, or company will be used to arrange for a higher salary level or calculate the seniority allowance exceeding the salary scale (if any) according to the regular salary increase regime, the seniority allowance exceeding the salary scale of the senior specialist level or equivalent.
c) The remaining cases are classified as specialist salary or civil servant salary, and the professional title of civil servant is equivalent to the specialist salary.
This Circular takes effect from December 5, 2018.
