New instructions on implementing the regime for district and commune officials and civil servants after the merger
(Baonghean.vn) - Implementing policies and regimes for cadres and civil servants after merging administrative units is considered a "difficult problem" that makes many localities confused. To unify the implementation process, the Central Organizing Committee recently issued Instruction No. 28-HD/BTCTW.
According to this Guide, the regime and policies for cadres, civil servants, public employees and workers in localities implementing the arrangement of administrative units at district and commune levels are stipulated as follows:
- Regimes and policies on recruitment, use, management and other policies for cadres, civil servants, public employees, workers at district-level agencies and units and commune-level cadres who are redundant due to organizational restructuring according to Resolution No. 37-NQ/TW of the Politburo, Resolution No. 653/2019/UBTVQH14 of the National Assembly Standing Committee shall be implemented according to Government regulations and instructions of the Central Organizing Committee.
Cadres who do not meet the age requirements for re-election or re-appointment to hold positions and titles according to their terms in agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, socio-political organizations in districts, towns, provincial cities and in communes, wards and towns shall be subject to Decree No. 26/2015/ND.-CP, dated March 9, 2015 of the Government; Instruction No. 27-HD/BTCTW, dated December 20, 2019 of the Central Organizing Committee.

In case of streamlining the payroll, restructuring the staff, civil servants, public employees and workers, it shall be implemented according to Decree No. 108/2014/ND-CP, dated November 20, 2014, Decree No. 113/2018/ND-CP, dated August 31, 2018 of the Government, Instruction No. 18-HD/BTCTW, dated December 5, 2018 of the Central Organizing Committee.
- Officials and civil servants who cease to hold leadership positions or hold leadership positions with position allowances(including election, appointment)lower than when the district and commune administrative units have not been arranged, but they are still cadres and civil servants at agencies, units and organizations in the political system in the administrative unit after the arrangement, they will receive full salary, allowances and reserve position allowances until the end of the term of the appointed position or the end of the term of the congress of that organization. After the above period, if they are arranged to a new position or title, they will follow the regulations of that new position or title; if they are not elected or appointed to leadership positions or titles, they will receive salary according to the rank, grade and allowances.(if coh)or take leave according to current regulations.
- In addition to the above-mentioned policies and regulations, on the basis of balancing the local budget, the provincial People's Committee shall submit to the People's Council of the same level to issue support policies for the contingent of cadres, civil servants, public employees, and redundant workers due to the rearrangement of the organizational apparatus when rearranging administrative units at the district and commune levels.(including in c)ahc. agencies, organizations, units of the Party Committee, the Vietnam Fatherland Front Committee, and mass organizationsyesdistrict and commune socio-politicalahn specialized departmenttrholding elected positions for a term at the commune level).
In the process of implementation, if there are any problems, the Party committees and Party organizations directly under the Central Committee are requested to promptly report to the Central Organizing Committee for synthesis and reporting to the Politburo.

Finding solutions to the problem of surplus after merging administrative units
(Baonghean) - Up to this point (March 2020), Nghe An has properly implemented the roadmap of Resolution No. 37-NQ/TW of the Politburo on the arrangement of commune-level administrative units. The issue that most people are most concerned about now is how to handle redundant cadres and civil servants, and how to use facilities after the merger to achieve the highest efficiency, create consensus, and avoid complaints from the grassroots level?
