Instructions on arrangement, layout and handling of public assets when implementing arrangement and reorganization of administrative units
The arrangement, organization and handling of assets must be appropriate to the management and usage objects, the nature and characteristics of the assets, making maximum use of existing asset resources but must have a long-term vision to serve long-term goals.
The People's Committee of Nghe An province has just issued an official dispatch on the arrangement, placement, and handling of public assets when reorganizing administrative units.

Nghe An Provincial People's Committee requests provincial and local agencies, organizations, units and unions to implement contents related to the arrangement, placement and handling of public assets when rearranging and reorganizing administrative units as follows:
Principles of asset handling when implementing administrative unit arrangement and reorganization:
Agencies, organizations, units, unions, and localities (hereinafter referred to as agencies, organizations, and units) subject to administrative unit arrangement shall implement:Inventory, classify, and make a list of public assets at agencies, organizations, and units according to the following groups: (1) Assets of agencies, organizations, and management units (including infrastructure assets assigned for management, assets being used for lease, joint ventures, associations, and exploitation), (2) Assets discovered to be in excess/shortage through inventory; (3) Assets not belonging to agencies, organizations, and units (assets held on behalf of others, borrowed assets, rented assets from other organizations and individuals, etc.).
Based on the results of the inventory and classification of assets, agencies, organizations and units are responsible for: (1) Handling assets discovered to be in excess/deficient through inventory (recording them in the assets of the agency or unit for assets discovered to be in excess; reducing assets in the accounting books and not summarizing them in the assets of the agency or unit for assets discovered to be in deficit; (2) Returning assets to other organizations or individuals for assets kept or borrowed; (3) Terminating the lease of assets (if agreed upon by the lessor and the termination of the lease does not affect the operations of the agency or unit); (4) Protecting and preserving the assets of the agency, organization or unit to avoid loss or leakage of assets.
Report to the agency responsible for developing a plan to arrange, allocate, and handle public assets at agencies, organizations, and units. The development of a plan to arrange, allocate, and handle public assets must be carried out simultaneously with the process of developing and synthesizing the Project to arrange and reorganize administrative units at all levels. The management and handling of assets of agencies, organizations, and units are carried out in accordance with each form of organizational arrangement according to the approval of competent authorities and the guidance of the Department of Home Affairs.
Carry out the handover and receipt of assets to agencies, organizations and units after the administrative unit arrangement according to the plan for arrangement, placement and handling of public assets approved by competent authorities; the handover and receipt shall be carried out according to Form No. 01/TSC-BBGN issued together with Decree No. 151/2017/ND-CP dated December 26, 2017 of the Government. Absolutely do not allow loss of assets to occur during the arrangement.
After completing the arrangement of administrative units, agencies, anddriveThe new unit is responsible for:Arrange the use of assets according to standards and norms for the use of public assets; manage and use public assets according to the provisions of law, ensuring savings and efficiency.
Identify surplus assets (no longer needed according to the new organizational structure) or those that must be handled according to legal regulations on management and use of public assets to prepare a dossier requesting handling, report to the competent authority or person for consideration and decision on handling according to regulations; do not allow the situation of leaving assets vacant, not using them, using them for the wrong purpose, or using them ineffectively, causing waste and loss.
Continue to carry out unfinished contents for assets that have been decided to be handled by competent agencies and individuals before the merger or consolidation, but by the time of the merger or consolidation, the handling has not been completed.
The arrangement, organization and handling of assets must be appropriate to the subjects of management and use, the nature and characteristics of the assets, making the most of the resources of existing assets but must have a long-term vision to serve long-term goals; it is not necessary to carry out the process of rearranging and handling houses and land according to the provisions of Decree No. 03/2025/ND-CP dated January 1, 2025 of the Government (stipulating the rearrangement and handling of public assets such as houses and land) when arranging, organizing and handling assets when rearranging and reorganizing administrative units. Prioritize the coordination and reasonable arrangement of assets between new grassroots administrative units in the locality. In case it is necessary to convert the function of the assets, the conversion of the function must be carried out according to regulations to serve the performance of functions and tasks.
The organization of implementation and specific handling of public assets shall be carried out in accordance with the provisions of law on management and use of public assets; guidance of the Ministry of Finance in Official Dispatch No. 2454/BTC-QLCS dated February 28, 2025, Official Dispatch No. 4891/BTC-QLCS dated April 15, 2025 and relevant guidance documents of competent authorities.
During the time when the competent authority or person is approving the Project on administrative unit arrangement, approving the plan for handling public assets or has not yet organized the handling of houses, land, and public assets according to the approved plan, the agency, organization, or unit that is managing and using the assets must protect and preserve the assets, avoid encroachment and loss; in case the arrangement has been made, the new agency, organization, or unit (after being merged, consolidated, or arranged) is responsible for preserving and protecting the assets and is responsible for carrying out the arrangement and handling of the assets.
Orientation for developing plans for arrangement, placement and handling of public assets:
For offices and business establishments: Priority is given to arranging working headquarters and public service facilities of district-level agencies, organizations and units (after abolishing the district level) for grassroots administrative units where the headquarters are located or other State agencies, organizations and units (including central agencies, organizations and units in the area) that need to use them as working headquarters and public service facilities; it is possible to arrange one working headquarters for many agencies, organizations and units to use according to the management methods prescribed in Point a, Point b, Clause 6, Article 4a. Decree No. 151/2017/ND-CP (amended and supplemented in Clause 5, Article 1, Decree No. 114/2024/ND-CP).

Carry out the exchange (transfer) of headquarters and public service facilities between provincial, district, commune-level agencies, organizations and units and central agencies in the area with headquarters that have surplus, excess or insufficient area compared to standards and norms; it is possible to arrange for many agencies, organizations and units to share one house and land facility to ensure maximum utilization of available facilities, headquarters and public service facilities in the area.
For the surplus headquarters and public service facilities after arrangement and reorganization, the asset handling shall be carried out in accordance with the provisions of law on management and use of public assets; in which, priority shall be given to converting functions to medical and educational facilities, and using them for other local public purposes (libraries, parks, cultural and sports institutions, etc.); reclaiming them for handing over to organizations with the function of managing and trading local houses for management and exploitation (management to serve the long-term goals of the State; preserving and protecting assets; arranging for temporary use by agencies and units; leasing houses attached to land; etc.), handing over to local land fund development organizations for management, development and exploitation in accordance with the provisions of law, etc.
For cars:For specialized cars serving specific activities, the handling shall be based on the principle that the agency, organization, or unit that receives the task shall receive the corresponding assets to continue performing the task. For cars serving the general work of district-level units after the district level is removed, they shall be assigned or transferred to agencies, organizations, or units that are still lacking or do not have assets, or shall be handled according to regulations.
For machinery, equipment and other assets:For specialized machinery and equipment, it is handled according to the principle that any agency, organization or unit that is assigned a task using specialized machinery and equipment will receive the corresponding assets according to regulations to continue performing the task.
For common machinery, equipment, shared machinery, equipment and other assets, priority should be given to utilizing assets that are still usable and transferring them to the new working location of the unit and officers, civil servants and public employees for continued use, ensuring the performance of tasks after the arrangement, without affecting the unit's operations; minimizing the need to purchase new assets.
In case of surplus, it will be transferred according to regulations between new local administrative units or handled according to regulations.
For infrastructure assets:Comply with current regulations, instructions of specialized management ministries and branches and instructions of specialized state management departments on infrastructure assets.
The Provincial People's Committee also assigned the People's Committees of districts, cities and towns to develop plans to arrange, allocate and handle public assets under their management; assigned relevant departments and branches, according to their functions and tasks, to be responsible for guiding the People's Committees of districts, cities and towns, and the People's Committees of communes, wards and towns to arrange, allocate and handle infrastructure assets under state management, along with developing and implementing the Project to arrange and reorganize administrative units.
