This is a regulation issued by the Ministry of Finance, the Ministry of Industry and Trade, and the Ministry of Transport.Joint CircularGuidelines for piloting the implementation of the National Single Window Customs Mechanism according to the Decision48/2011/QD-TTgof the Prime Minister.
The applicable entities include businesses involved in import and export of goods, vehicles entering, exiting, and transiting the country; and organizations and individuals involved in the export, import, and transit of goods and vehicles who choose to carry out administrative procedures through the National Single Window Portal and meet the information technology and technical requirements as prescribed.
The circular clarifies that electronic transactions on the National Single Window Customs Mechanism (electronic transactions) include declaring and receiving feedback on the processing of dossiers for single-window administrative procedures on the National Single Window Portal; receiving and transferring declaration information from the National Single Window Portal to specialized processing systems; receiving processing results from specialized processing systems to the National Single Window Portal…
It has the same value as a paper document.
Regarding the legal validity of single-window customs administrative documents, the Circular stipulates that single-window customs administrative documents have the same value as paper documents.
The sending, receiving, storage, and legal validity of single-window customs administrative documents are governed by the Law on Electronic Transactions and other relevant legal regulations. Single-window customs administrative documents must bear the digital signature of an authorized person as prescribed by specialized laws for single-window administrative procedures (in cases where the declarant registers to use a digital signature).
This Circular takes effect from August 28, 2013.
| According to the Decision48/2011/QD-TTgAccording to the Prime Minister's directive, the National Single Window Customs Mechanism is an integrated system that allows: a) Parties involved in export and import activities submit or send standardized information and documents to a single receiving point; b) State agencies process data and information and make decisions based on a system of unified and synchronized processes and procedures; they make decisions and send these decisions to the agreed-upon system for providing and exchanging unified information between state agencies; c) The Customs authority makes the final decision on customs clearance and release of exported, imported, or transit goods, or outgoing, incoming, or transit transport vehicles, based on decisions of relevant State agencies that are promptly transmitted through the system in accordance with regulations on public service provision. Regarding the pilot implementation roadmap,From January to December 2013, the pilot program was implemented in agencies and units under the Ministry of Industry and Trade, the Ministry of Finance (General Department of Customs), the Ministry of Transport, and some local government agencies in the finance, industry and trade, and transport sectors; From January to December 2014, the pilot program will be expanded to agencies under the Ministry of Health, the Ministry of Agriculture and Rural Development, the Ministry of Natural Resources and Environment, and a number of local government agencies in the health, agriculture and rural development, and natural resources and environment sectors. In December 2014, the pilot program was reviewed and proposals were made for the official implementation of the National Single Window Customs Mechanism in the next phase. |
