Plan for summarizing 10 years of the Law on Prevention and Combat of Corruption

(Baonghean.vn) - The People's Committee of Nghe An province issued document No. 539/UBND-KH dated September 3, 2015, regarding the plan to summarize 10 years of implementing the Law on Prevention and Combat of Corruption in Nghe An province. The content of the document is as follows:

I. OBJECTIVES AND REQUIREMENTS:

This review of 10 years of implementing the Law on Prevention and Combat of Corruption aims to assess the situation of its implementation, the reality of corruption, and the effectiveness of measures to prevent, detect, and handle corruption nationwide since the enactment of the Law on Prevention and Combat of Corruption in 2005; to clarify the achievements, advantages, disadvantages, limitations, weaknesses, obstacles, difficulties, and their causes; to draw lessons learned, and from there propose measures and solutions as a basis for improving the system of policies and laws on anti-corruption, focusing on comprehensively amending the Law on Prevention and Combat of Corruption; to strengthen and improve the effectiveness of anti-corruption measures; and to set out key tasks and breakthroughs in anti-corruption work in the next phase.

The review of 10 years of implementing the Law on Anti-Corruption must be comprehensive and in-depth; based on a specific assessment of the results of implementing the provisions of the Law on Anti-Corruption; closely adhering to the tasks and solutions for anti-corruption in Resolution No. 3 of the 10th Central Committee on strengthening the Party's leadership over the work of preventing and combating corruption and waste; and linked to an assessment of the implementation of the National Strategy on Anti-Corruption until 2020 and the Government's Action Program to implement the Conclusion of the 5th Central Committee Meeting of the 11th Party Congress.

The review process must be conducted promptly, seriously, scientifically, and economically; promoting democracy, a sense of responsibility, initiative, and creativity among relevant departments, localities, agencies, and organizations, based on the self-assessment results of higher levels regarding lower levels.

II. SUMMARY OF CONTENT

1. Leading and directing the organization, implementation, dissemination, and education of laws on anti-corruption, the National Anti-Corruption Strategy to 2020, the Government's Action Program on Anti-Corruption, and the United Nations Convention against Corruption.

2. The development and improvement of institutions and policies on anti-corruption.

3. The organizational model of anti-corruption agencies and the coordination of work among these agencies.

4. Implementing measures to prevent corruption.

5. Detecting and dealing with acts of corruption.

6. The work of recovering assets obtained through corruption.

7. Monitoring activities related to anti-corruption work.

8. The role and responsibilities of socio-political organizations in combating corruption.

9. Assess the corruption situation and its causes; the main difficulties and obstacles in implementing the Law on Anti-Corruption; causes, lessons learned, recommendations, and proposed solutions.

III. IMPLEMENTATION ORGANIZATION

1. The Provincial Inspectorate will guide departments, agencies, and the People's Committees of districts, cities, and towns in preparing and submitting summary reports according to the guidelines of the Government Inspectorate; and at the same time, compile the results and draft a summary report on 10 years of implementing the Law on Anti-Corruption throughout the province.

2. Departments, agencies, and localities shall develop specific plans to conduct the review and submit the review report in accordance with the guidance of the Provincial Inspectorate.

In addition to implementing the above contents, the following departments, agencies, and related bodies are responsible for supplementing the comprehensive assessment report with certain contents within their respective areas of state management, specifically:

a) The Department of Justice shall take the lead in preparing one specialized report on:

-Evaluate the work of disseminating, popularizing, and educating the public about anti-corruption laws throughout the province.

- Orientation towards improving criminal policy in handling corruption.

b) The Provincial Police Department shall take the lead in preparing one specialized report on:

- Coordination among relevant agencies in the detection, investigation, prosecution, trial, and execution of sentences for corruption crimes;

-Detecting and addressing corruption in investigative work.

c) The Department of Internal Affairs shall take the lead in preparing one specialized report on:

- Administrative reform efforts contribute to preventing corruption.

- Some measures to prevent corruption include: developing and implementing codes of conduct, public service ethics, and professional ethics; periodically rotating the positions of officials, civil servants, and public employees; holding heads of departments accountable when corruption occurs; and temporarily suspending or transferring officials to other positions when there are signs of corruption.

d) The Department of Finance shall take the lead in developing a specialized report on the development and implementation of regulations, norms, and standards on finance and the management and use of public assets (linked to the results of implementing the Law on Practicing Thrift and Combating Waste).

d) The Provincial State Treasury shall take the lead in developing a specialized report on salary payments via bank accounts for those receiving salaries from the state budget and implementing a plan to reduce the use of cash.

e) The Department of Natural Resources and Environment shall take the lead in developing one thematic report on openness and transparency in state management of land; mineral resources, geology; and environment.

g) The Department of Planning and Investment shall take the lead in preparing one thematic report on transparency in the implementation of investment projects and bidding activities using state budget funds.

3. The Provincial People's Committee requests that relevant agencies take the lead in summarizing, evaluating, and providing information on the following issues:

a) The Provincial Party Committee's Internal Affairs Department will take the lead in preparing one thematic report with the following content:

- Model of the agency directing anti-corruption work according to the Law on Anti-Corruption and the results of the Provincial Steering Committee on Anti-Corruption's activities.

- The current situation, operating mechanisms, rationality, and effectiveness of agencies, organizations, and focal points that advise and assist in anti-corruption work.

b) The Legal Affairs Committee of the Provincial People's Council shall prepare a specialized report on the work of monitoring anti-corruption and the detection and handling of corruption.

c) The People's Procuracy shall take the lead in preparing one specialized report on the work of supervising the investigation and prosecution of corruption crimes.

d) The People's Court shall take the lead in preparing one thematic report on the work of adjudicating corruption crimes.

d) The Provincial Civil Enforcement Department shall prepare a specialized report on the recovery of assets obtained through corruption via civil enforcement in corruption cases; and the obstacles and difficulties encountered in the recovery of assets obtained through corruption.

e) The Provincial Fatherland Front Committee and provincial political and social organizations shall evaluate and provide information on their activities in the fight against corruption over the past 10 years (focusing on the results of activities, roles, and responsibilities in the fight against corruption of agencies and organizations; of the People's Inspection Committees of communes, wards, and towns;...).

IV. IMPLEMENTATION TIME AND BUDGET

1. Timeframe

Departments, agencies, localities, and organizations shall implement the plan and guidelines for the summary immediately after receiving the plan from the Provincial People's Committee; send the draft report and compiled data on the results of 10 years of implementing the Law on Anti-Corruption to the Provincial Inspectorate before October 30, 2015; organize a summary conference and complete and send the summary report to the Provincial Inspectorate before November 31, 2015.

The Provincial People's Committee is organizing a conference to summarize 10 years of implementing the Law on Prevention and Control of Corruption, tentatively scheduled for January 2016.

2. Funding

Departments, sectors, localities, agencies, and organizations shall allocate funds for the implementation of the review within the annual budget estimates assigned by competent authorities in accordance with the provisions of the State Budget Law.
