(Baonghean.vn) -Continuing its program to survey the issuance of land use rights certificates, house ownership certificates, and certificates for assets attached to land in apartment complexes and new urban areas, on the morning of March 18th, the Legal Affairs Committee of the Provincial People's Council conducted a survey at the Petroleum Investment and Trading Joint Stock Company.

Currently, Nghe An Petroleum and Trading Joint Stock Company has two apartment and urban development projects: the Petroleum Building (in Quang Trung ward) and a mixed-use complex project including high-end apartments, offices, and townhouses (in Nghi Phu commune). The Nghe An Petroleum Building project, already constructed and in operation, consists of two towers: one for office rentals and one for apartments with 126 units.

The current obstacle in this project lies in the issuance of ownership certificates for the apartment building. Although the competent authority has issued certificates to the investor, the issuance of certificates to individual users has not been fully completed. Specifically, out of a total of 126 apartments, the investor has sold 108, of which 69 are occupied. However, due to multiple resale transactions and some owners not fulfilling their financial obligations, they are not enthusiastic about completing the procedures to obtain their ownership certificates. This has resulted in only 14 out of 108 apartment owners having completed the procedures to obtain their certificates. Regarding the office building for rent, although the investor has leased it to organizations and businesses for short-term and long-term periods, regulatory issues prevent these organizations and businesses from owning the leased property, especially those paying in a lump sum.

Regarding the mixed-use service complex project, including high-end apartments, offices, and townhouses (in Nghi Phu commune), the current obstacle is that customers prefer to transact in the form of subdivided land plots rather than having the developer build houses for them to buy, thus hindering transactions. Based on this reality, the investor requests that the competent authorities address this issue in a way that both facilitates the project for the investor and benefits consumers.

Through the survey, the working group of the Legal Affairs Committee of the Provincial People's Council noted that the issuance of certificates of ownership for apartments in the company's two projects is still low. For example, in the Nam Nguyen Sy Sach new urban area project, certificates have only been issued for 10 out of 10 townhouses and 104 villas. As for the 17-story apartment building with 84 apartments, although 75 out of 84 apartments have been occupied since 2011, no households have yet received certificates of ownership.

Similarly, the low-income housing project (in Block 7, Trung Do Ward), consisting of 7 floors and 50 apartments, was put into use in April 2012 with 49 apartments occupied, but is currently only in the stage of applying for land use conversion to low-income housing and preparing the conditions for applying for land use right certificates, ownership certificates, and certificates for assets attached to the land. The reasons for the delay in issuing the certificates, besides the subjective factors of apartment owners who have not fulfilled their financial obligations or are not enthusiastic about the procedures for obtaining ownership certificates, are still some procedural and regulatory obstacles at various levels.

Based on the information gathered, the survey team recommended that Trung Do Joint Stock Company continue to coordinate with relevant authorities and homebuyers to expedite the issuance of land use certificates, paying particular attention to homeowners living in apartment buildings. The company's recommendations will be compiled and studied for future proposals to relevant levels and sectors to address the issues.
