When stopping a vehicle for inspection, at the traffic police checkpoint, is it necessary to use a camera to record the inspection activities of the traffic police team? This is a concern of Mr. Le Quoc Chinh (Do Luong, Nghe An).

Reply: Pursuant to Article 12, Circular 73/2024/TT-BCA stipulates the stopping of vehicles participating in road traffic for control as follows:

Stop vehicles participating in road traffic for control

1. Traffic police officers performing patrol and control duties according to plan are allowed to stop vehicles participating in road traffic for control according to the provisions of Article 65 and Article 66 of the Law on Road Traffic Order and Safety.

2. Stopping and controlling vehicles must ensure the following requirements:

a) Safe, in accordance with the law, and not causing obstruction to traffic activities;

b) When stopping a vehicle, it is necessary to carry out inspection and handle violations (if any) according to regulations.

3. When checking at a point on a traffic route, at the Traffic Police Station, the requirements specified in Clause 2, Article 6, Clause 2 of this Article and the following requirements must be ensured:

a) Place barriers with conical posts or ropes stretched along the road in the road section, lane close to the roadside or sidewalk to form an area for public service according to the regulations of the Ministry of Public Security on implementing democracy in ensuring traffic order and safety. Based on the actual situation and characteristics of the traffic route, deploy the appropriate length of the barrier to ensure safety;

b) The area where official duties are performed must comply with the provisions of the law on road traffic order and safety and other relevant legal provisions; have sufficient space to arrange and install professional technical equipment and means, carry out control contents, receive citizens to resolve and handle cases; based on the actual situation in the area where official duties are performed and the subject of control, it is possible to arrange traffic police officers to guide, regulate traffic, ensure traffic safety...

Referring to Clause 2, Article 6, Circular 73/2024/TT-BCA stipulates:

Organize forces to directly patrol and publicly control road traffic routes.

...2. Control at a point on the road, at the Traffic Police Station

a) Traffic police organize forces at a point on the road, at the Traffic Police Station according to the plan issued by the competent authority to stop vehicles, control, detect, and handle violations of the law on road traffic order and safety and other violations of the law within their authority;

b) At a point on the road, choose a location with a wide, open road surface that does not obstruct vision and complies with the provisions of the law on road traffic order and safety, road laws and related laws;

c) When organizing a control force at a point on a traffic route, at a Traffic Police Station, it is necessary to use a camera equipped to record the control activities of the Traffic Police Team. Control at night must have lighting and ensure adequate lighting...

Thus, one of the requirements that the Traffic Police checkpoint must ensure is that when organizing a control force at a point on the road, the Traffic Police checkpoint must use a camera equipped to record the control activities of the Traffic Police Team.
