When patrolling and controlling, what rights do traffic police have?
(Baonghean.vn) - On June 19, 2020, the Ministry of Public Security issued Circular No. 65/2020/TT-BCA stipulating the tasks, powers, forms, contents and procedures for patrolling, controlling and handling administrative violations of road traffic by the Traffic Police. Starting from August 5, 2020, the Circular officially takes effect.

Circular No. 65 has specific regulations on the authority of the Traffic Police in patrolling and controlling. Among them, there are the following notable contents:
The first,Stop vehicles participating in road traffic according to the provisions of the Road Traffic Law, this Circular and other relevant legal provisions. Control people and vehicles participating in road traffic, documents of vehicle drivers, documents of vehicles and personal documents of people on vehicles under control according to the provisions of law; control the implementation of regulations on road transport activities according to the provisions of law.
Second,Measures to prevent and handle violations of road traffic, social order and other violations according to the provisions of law are applied.
Third,Request agencies, organizations, individuals to coordinate and support in resolving accidents, traffic jams, traffic obstructions or other cases that cause disorder and disruption of road traffic safety. In urgent cases to protect national security, ensure social order and safety or to prevent consequences of damage to society that are occurring or are at risk of occurring, the Traffic Police on patrol and control duties may mobilize means of transport, means of communication, other means of transport of agencies, organizations, individuals and the people who are driving and using such means. Mobilization is carried out in the form of direct requests or in writing.

Wednesday,equipped, installed, and used with means of transport, vehicles, technical equipment, weapons, and support tools according to the provisions of law and the Ministry of Public Security.
Thursday,temporarily suspend traffic on certain road sections, re-allocate traffic lanes, re-allocate routes and places for stopping and parking vehicles when there is a traffic jam, traffic accident or when there are other necessary requirements to ensure security, order and social safety.
Friday,exercise other powers of the People's Public Security force as prescribed by law.
In addition, Article 16 of the Circular stipulates that Traffic Police performing patrol and control duties according to plan are allowed to stop vehicles for control in the following cases:
- Directly detect or through professional technical means and equipment detect and record violations of road traffic laws and other violations of laws;
- Implement orders and plans for general control of road vehicles, patrol, control and violation handling plans according to topics approved by competent authorities.
- There is a written request from the Head or Deputy Head of the investigation agency; a written request from a relevant competent authority to stop a vehicle for inspection to serve the work of ensuring security, order, fighting against crime and other violations of the law. The written request must specifically state the time, route, vehicle to be stopped for inspection, handling, and participating forces;
- Reports, reflections, recommendations and denunciations from organizations and individuals about violations of the law by people and vehicles participating in road traffic.
