On August 4, the People's Court of Ho Chi Minh City tried and sentenced defendant Nguyen Viet Thanh (71 years old, residing in Dong Thap province) to 8 years and 6 months in prison for fraud and property appropriation.
At the same time, the court also sentenced Diep The Nhu (66 years old, residing in District 5, Ho Chi Minh City) to 2 years and 6 months in prison but suspended the sentence for bribery.
Previously, Thanh was sentenced to 1 year and 6 months in prison by the People's Court of Dong Thap province for fraud and property appropriation, but Thanh escaped execution of the sentence and was wanted by Dong Thap province police.
According to the indictment, Ms. Nhu has two children, Nguyen The Lam and Nguyen The Thien, who were prosecuted and detained by District 8 Police, Ho Chi Minh City, for intentionally causing injury.
Hearing Nguyen Viet Thanh say that his brother-in-law was working at the Ministry of Public Security, around February 2014, Mrs. Nhu went to Thanh's residence to ask Thanh to help her two children get released on bail.
After that, Thanh contacted a man named Dang Thanh Xuyen to take care of Mrs. Nhu's two children on bail, but Xuyen asked for 200 million.
On February 11, 2014, Thanh informed Ms. Nhu that he had contacted the District 8 police and said that Ms. Nhu's two children would be released on bail for 250 million VND.
On the same day, Mrs. Nhu came to Thanh's place and gave him 50 million in advance, but Thanh asked for the full amount to be taken care of. Because she trusted Thanh, Mrs. Nhu borrowed money from many places to have enough money to give to Thanh.
The next afternoon, Nhu came to meet Thanh to hand over the money and Thanh wrote a note saying that he had received the full amount and that Thanh's children would not be held criminally responsible. In addition, Thanh also agreed that if Nhu's children were not released on bail within 3 days, Thanh would return the money.
After that, Thanh called Xuyen to get money to "fix the case". Xuyen met and gave 200 million VND to a person named Hoang Thi Kim Anh to take care of this matter, but later Xuyen could not take care of it and returned the 200 million VND to Thanh.
However, Thanh did not return the money to Nhu but kept it and spent it before fleeing. While on the run, Thanh asked a relative to return 190 million VND to Nhu.
After 3 days of not seeing her child released on bail, Nhu called Thanh but Thanh did not answer the phone, so Nhu filed a complaint against Thanh with the police.
According to Kim Anh's statement, because Xuyen only asked her to help him ask a lawyer, but Kim Anh later said she couldn't answer, Kim Anh did not ask Xuyen for money, so the investigation agency determined that Kim Anh was not criminally responsible in this case.
As for Dang Viet Xuyen, he voluntarily stopped committing the crime halfway, so he is also exempted from criminal liability.
