Prosecution of former Chairman and commune land officials for embezzlement of property

(Baonghean.vn) - The leader of Nghia Dan District Police said that they have initiated a case and prosecuted Mr. Le Viet Sy - former Chairman of the People's Committee and Mr. Nguyen Huu Sam - cadastral officer of Nghia Thinh Commune for embezzlement of property.

Previously, in July 2012, the People's Committee of Nghia Dan district received a petition from a citizen denouncing Mr. Le Viet Sy - former Chairman of the People's Committee of the commune and Mr. Nguyen Huu Sam - cadastral officer of Nghia Thinh commune.

Nghia Dan District People's Committee established a team to verify the incident and concluded that, during the auction of Co Voi land, the District People's Committee reclaimed 5,195 square meters of public land from Nghia Thinh Commune People's Committee and compensated and supported with an amount of 140,265,000 VND.

Document No. 480 of the People's Committee of Nghia Dan district on transferring the case file to the Investigation Police Agency of Nghia Dan district Police for consideration and settlement.

When receiving compensation, Mr. Sy and Mr. Sam took advantage of their positions and powers to embezzle the above amount without paying it into the State budget.

On that basis, the People's Committee of Nghia Dan district determined that the actions of Mr. Sy and Mr. Sam showed signs of violating Article 278 of the Penal Code, amended and supplemented in 2009, which stipulates the crime of "embezzlement of property".

On July 26, 2016, the Chairman of the People's Committee of Nghia Dan district sent Official Dispatch No. 480/UBND-TTr regarding the transfer of the case to the investigation agency of Nghia Dan district police for consideration and settlement according to legal regulations.

After the investigation, Nghia Dan District Police initiated a criminal case and prosecuted Mr. Le Viet Sy - former Chairman of the People's Committee and Mr. Nguyen Huu Sam - cadastral officer of Nghia Thinh commune for embezzlement of property to continue to clarify the violations.

It is known that Mr. Sy and Mr. Sam voluntarily returned the embezzled amount of more than 140 million VND to remedy the consequences.
