Prosecution of the Director and Wife of Minh Khang Trading Co., Ltd.
(Baonghean.vn) - Previously, on August 15, 2021, the Provincial Police Investigation Agency issued Decision No. 110/VPĐTCAT to prosecute a criminal case for the crime of "Fraudulent appropriation of property" at the Project invested by Minh Khang Company Limited.
On the afternoon of September 16, 2021, the Investigation Police Agency of the Provincial Police Department issued a decision to prosecute Ms. Nguyen Thi Thu - Director of the Company for fraud and property appropriation.Minh Khang Trading Company Limitedand Mr. Nguyen Dinh Khang - Head of Minh Khang Urban Area Project Management Board.

Ms. Nguyen Thi Thu, born in 1956, from Hai Duong province, Director of Minh Khang Trading Company Limited, is the legal representative; Mr. Nguyen Dinh Khang, born in 1948, from Hai Duong province, Ms. Thu's husband is the Head of the Management Board of Minh Khang Urban Area Project. During the project implementation, Ms. Nguyen Thi Thu and Mr. Nguyen Dinh Khang committed fraud and appropriated people's property.

Based on the documents and evidence, the Provincial Police Investigation Agency has decided to prosecute Ms. Nguyen Thi Thu and Mr. Nguyen Dinh Khang for fraud and property appropriation. At the same time, it has issued an order to temporarily detain Ms. Nguyen Thi Thu and Mr. Nguyen Dinh Khang for a period of 4 months.
On the same afternoon, the Investigation Police Agency of Nghe An Province Police issued a decision to prosecute and execute an arrest warrant for the two suspects; at the same time, searched the workplace of the two suspects, confiscating many related documents and evidence.

The project to build a complex of hotels, supermarkets, pharmaceuticals - medical equipment and housing in Nghi Phu commune (Vinh city), was approved for detailed planning in Decision 521/QD-UBND.DT in 2007, with a total area of 7.86 hectares; the west of the project borders Xo Viet Nghe Tinh street, the north borders a 72m wide planned road, the south borders a 30m wide planned road, and the east borders Truong Van Linh street. Of which, the construction area is 1.77 hectares (construction density is only about 27%).
Up to 2014, the project of Minh Khang Trading Company Limited has undergone 4 planning adjustments. Specifically, the first planning adjustment was on September 1, 2010, in Decision No. 4283/QD.UBND-XD; the second planning adjustment was on April 13, 2013, in Decision No. 1335/QD.UBND-XD; the third planning adjustment was on April 8, 2014, in Decision No. 1376/QD.UBND-XD; the fourth planning adjustment was on September 24, 2014, in Decision No. 4764/QD.UBND-XD.
Coincidentally, in the planning adjustments, the construction area of public works and social welfare works decreased, while the land area for low-rise housing construction increased. An inspection report pointed out that, compared to the first planning adjustment decision (Decision No. 4283/QD.UBND-XD), to the fourth planning adjustment decision (Decision No. 4764/QD.UBND-XD), the public land area decreased by 15,270 m2, increased by 56 plots of land; bringing the total number of plots of land in this project to 295.
However, Minh Khang Trading Company Limited continued to arbitrarily “adjust” the project, and also in the direction of reducing the construction area of public works and social welfare works to increase the land area for housing construction. Thereby increasing the total number of residential land lots in this project from 295 to 324 lots.

On September 7, Nghe An Electronic Newspaper also reported on the tax arrears at Minh Khang Trading Co., Ltd. Accordingly, since 2018, Minh Khang Trading Co., Ltd. has begun to form a debt for land use fees to the state budget. This is the time when the Provincial People's Committee issued a decision approving the average land price of the land area where Minh Khang Trading Co., Ltd. implemented the project of hotel complex, supermarket, pharmaceutical business, medical equipment and housing in Nghi Phu commune, Vinh city, with an area of land use fees of 16,554.1m2.2On May 30, 2018, the tax authority notified Minh Khang Trading Co., Ltd. that the total land use fee payable to the State budget is VND 210,803,962,000.
However, after more than 3 years, Minh Khang Trading Co., Ltd. still has not paid taxes according to the law. As a result, the total amount of tax that Minh Khang Trading Co., Ltd. has not paid to the State budget as of August 2021 is up to 281,520,801,745 VND. Of which, land use fee is 210,803,962,000 VND; non-agricultural land use tax is 1,423,682,262 VND; late payment fee is 69,293,175,483 VND.
