Ms. Ho Thi Kim Thoa is a case under consideration and investigation, so her resignation is not approved.

At the Government press conference on the afternoon of August 3, responding to the press about the resignation of Deputy Minister of Industry and Trade Ho Thi Kim Thoa, Minister - Head of the Government Office Mai Tien Dung said: "The Government Personnel Committee has received the resignation of Deputy Minister Ho Thi Kim Thoa. The Prime Minister is assigning the Ministry of Home Affairs to consider. However, according to regulations, cases that are under consideration and investigation cannot be approved for resignation."

Previously, at the 16th Conference of the Central Inspection Committee, the Central Inspection Committee met and proposed that competent authorities consider dismissing the current position of Deputy Minister of Industry and Trade Ho Thi Kim Thoa. Thus, the management of the Deputy Minister of Industry and Trade belongs to the Secretariat. If the Secretariat agrees with the proposal of the Central Inspection Committee, the competent authorities will carry out this work. As for the Government, the Prime Minister assigned the Minister of Home Affairs and the Party Committee of the Ministry of Industry and Trade to follow the correct procedure if the Secretariat agrees with the proposal of the Central Inspection Committee.

The second issue is that on July 31, the Government Party Committee received a report from the Party Committee of the Ministry of Industry and Trade and the resignation letter of Deputy Minister of Industry and Trade Ho Thi Kim Thoa. Currently, the Prime Minister is assigning the Minister of Home Affairs and the Party Committee of the Ministry of Home Affairs to review and propose to the Government Party Committee.

However, according to the Law on Civil Servants and Decree 46/2010 implementing this law, when an official is under investigation or under disciplinary review, he/she cannot accept resignation.

Regarding Ms. Thoa’s assets, if they are proven to be legal, they cannot be recovered. The investigation agency will be responsible for clarifying this. At this time, there is no question of examining Ms. Thoa’s assets.

Previously, on the evening of August 1, the Ministry of Industry and Trade confirmed that Deputy Minister of the Ministry, Ms. Ho Thi Kim Thoa, had submitted a resignation letter to the leaders of the Ministry of Industry and Trade.
