Even if you are not in the transportation business, you must register your business.

Previously, the conditions for freight transport business only applied to those who transported goods for hire for others, not to individuals or businesses that transported their own goods.

However, according to Decree 86/2014 on business and conditions for automobile transportation business, enterprises owning trucks from 3.5 tons to under 7 tons are classified as "transport business without direct collection of money" and must still re-register their business to be granted a badge, otherwise they will be fined.

Many businesses that transport their own goods are also required to register for transportation business.

Is self-transportation considered a transportation business?

According to the Ho Chi Minh City Industrial Park Enterprises Association (HBA), many enterprises in industrial parks (IPs) that have their own trucks to transport goods have sent petitions to the HBA that they are not transport businesses but still have to register for transport business and attach business badges for vehicles over 3.5 tons and under 7 tons.

According to the enterprises, they must register their transportation business to get a business license at the Department of Planning and Investment (DPI) of the city; register their transportation business to get a transportation license and attach badges and black boxes to their vehicles at the Department of Transport (GTVT) of the city. However, in reality, these enterprises do not operate transportation, do not collect fees from any unit and have automatically installed black boxes for management. Having to do additional administrative procedures as above is cumbersome and unnecessary.

For example, Tan Quang Minh Production and Trading Company Limited (Lot C21/I, Road 2F, Vinh Loc Industrial Park, Binh Chanh), the company has 2 trucks with a capacity of 4,750 kg; 2 trucks with a capacity of 4,900 kg to transport the company's goods to distributors. According to regulations, the company has submitted an application for a badge for 4 vehicles to the Department of Transport, but this department requires the company to add the business of transporting goods by car to the business registration certificate, then submit an application for a business license for transporting goods by car. Only when this license is available can the application for a vehicle badge be submitted.

The problem here is that the company operates in the beverage production sector, using company vehicles to transport its goods to customers, but the company does not operate a car transport business. Mr. Nguyen Dang Hien, Director of Tan Quang Minh Company, said that the above regulation has caused many difficulties for businesses.

Sub-licenses should be limited.

Regarding the above issue, Mr. Le Hoang Minh, former Deputy Director of the Department of Transport of Ho Chi Minh City, said that in Clause 3, Article 3 of Decree 86/2014, it is stipulated that non-directly collected transportation business is a transportation business by car, in which the business unit both performs the transportation stage and performs at least one other stage in the process of production to consumption of products or services and collects transportation fees through revenue from that product or service.

Thus, according to this decree, Tan Quang Minh Company will fall into the case of a transportation business company that does not collect money directly and is required to register for transportation business.

Mr. Nguyen Van Be, Chairman of the Association of Industrial Park Enterprises in Ho Chi Minh City, said that the issuance of regulations and circulars is aimed at better managing the operations of enterprises. However, how to implement and deploy them to create favorable conditions for enterprises to operate needs to be carefully calculated.

Otherwise, when the vehicles of enterprises are on the road, they will certainly be fined by the police for not having a badge. To apply for a badge, you must have a transport business license. To apply for a transport business license, the business registration certificate must have a transport business code. To have a transport business code, you must request to amend the business registration certificate. With a series of sub-licenses like that, it will be very difficult for enterprises to operate.

“HCMC is encouraging individual households to become enterprises, but with the current difficulties that enterprises are facing, it will be very difficult to do this. We should limit cumbersome procedures to help enterprises operate better,” Mr. Be suggested.
