Proposal for vehicles with 15 days overdue inspection to be moved
Speaking with Lao Dong Newspaper, a representative of the Ministry of Transport said that the Ministry has just sent a document recommending that the Government and the Prime Minister apply a number of measures to remove difficulties in vehicle inspection activities.
On March 9, Deputy Minister of Transport Le Dinh Tho signed Document No. 2329/BGTVT-KHCN&MT on removing difficulties in motor vehicle inspection activities, meeting the ability to provide public services to the people.
The Ministry of Transport recommends that the Government assign the Ministry of Transport to promptly study and develop a Decree amending and supplementing Decree No. 139/2018/ND-CP (Decree 139) according to simplified procedures to update and supplement regulations in accordance with the current situation and development trends.
In the immediate future, during the time of drafting the Decree amending and supplementing Decree 139, the Ministry of Transport recommends that the Government and the Prime Minister issue a Resolution allowing the application of a number of specific mechanisms and policies to resolve the current congestion situation of automobile inspection.
Accordingly, the Ministry of Transport proposed to allow the use of inspection forces of the Ministry of Public Security and the Ministry of National Defense to participate in the inspection of motor vehicles at inspection centers.
Genuine warranty and maintenance facilities of automobile manufacturers, assemblers and importers that meet the regulations on warranty and maintenance facilities in Decree No. 116/2017/ND-CP and have equipment and human resources meeting QCVN 103:2019/BGTVT (National technical regulations on motor vehicle inspection units) are allowed to operate automobile inspection.
Allow vehicles with overdue registration within 15 days to move to the registration units to conduct technical safety and environmental protection inspection according to regulations. These vehicles are not allowed to carry people, goods, or do transportation business.

The Ministry of Transport also proposed to amend some current regulations in Decree 139 as follows:
In Clause 1, Article 7:
Current regulations: “1. Each inspection line must have at least 03 inspectors, including at least one senior motor vehicle inspector”.
Proposed application: “1. Each motor vehicle inspection unit must arrange 01 senior inspector, each inspection line must arrange inspectors with sufficient capacity to fully perform all inspection stages”.
Reason: When applied, this new regulation will utilize and exploit the maximum capacity of inspection units while still ensuring technical safety quality and environmental protection according to the provisions of law.
At point b, clause 2, Article 14
Current regulations: “b) Have at least 12 months of professional internship as a vehicle inspector according to the content prescribed by the Ministry of Transport;”
Proposed application: “b) Have at least 12 months of professional internship as a vehicle inspector according to the content prescribed by the Ministry of Transport. In case the trainee has direct experience in performing maintenance and repair work at a car warranty and maintenance facility for 36 months or more, from 24 months to less than 36 months, from 12 months to less than 24 months (with confirmation from the warranty and maintenance facility), the minimum internship period is 03 months, 06 months, 09 months respectively”.
Reason: Reduce internship time for students who have practical work experience and fully meet the professional capacity for inspection activities.
In Clause 3, Article 19
It is proposed to apply the case of inspectors whose certificates have been revoked according to the provisions of Clause 6, Article 18, Decree 139 (including inspectors who have retired according to the regime) to be re-evaluated to grant inspector certificates".
Reason: Eliminate internship time for inspectors who have practical work experience but have not directly performed inspection work or guided or evaluated inspectors' professional work for more than 12 months.
Article 26
Current regulations: “Article 26. Number of motor vehicles inspected by the inspection unit: The number of motor vehicles granted inspection certificates per day (calculated within 08 working hours) must simultaneously satisfy the following regulations:
1. In case one inspector inspects one vehicle on the inspection line, the number of vehicles shall not exceed 20; in case many inspectors inspect one vehicle on the inspection line, the number of vehicles shall not exceed 20 times the number of inspectors.
2. No more than 90 vehicles for a type I inspection line and no more than 70 vehicles for a type II inspection line. In case the type II inspection line is only used to inspect motor vehicles with a mass distributed on each single axle up to 2,000 kg, the number of inspected vehicles shall be applied as for the type I line”.
Proposal not to apply Article 26
Reason: unlimited capacity to maximize the capacity of the inspection unit.
Allow inspection units that have been suspended from operation (for a period of 01 month or 03 months as prescribed in Article 10, Decree 139) to resume operation if they have met the conditions on facilities and human resources as prescribed in Decree 139.
The Ministry of Transport emphasized that if the above recommendations are considered and approved by the Government and the Prime Minister, the Ministry of Transport will coordinate with agencies and units to promptly implement them to meet the needs of the people; coordinate with the Ministry of Public Security and the Ministry of National Defense to have a plan to use the inspection force of the Ministry of Public Security and the Ministry of National Defense to participate in the inspection of motor vehicles, and at the same time study and update the content of the Decree amending and supplementing Decree 139 of the Government.
To date, the police have prosecuted and detained more than 400 leaders and inspectors at more than 68 motor vehicle inspection units. 55/281 inspection units have stopped operating, leading to serious congestion at inspection units, especially in Hanoi, Ho Chi Minh City, Hoa Binh, etc., affecting the ability to serve the needs of motor vehicle inspection for people and businesses.
