This procedure takes effect from January 3, 2018, replacing the previously issued procedures on inspection and enforcement of party discipline.
Three steps to review and discipline party members under the management of the Politburo and Secretariat
The process of reviewing and enforcing disciplinary measures on party members under the management of the Politburo, the Secretariat and lower-level Party Committee members directly under the Central Committee upon disciplinary action proposals is carried out in three strict steps: preparation step; implementation step and conclusion step.
Inpreparation step: Based on the disciplinary action proposal file and the results of supervision and situation assessment, the department head of the field and area reports and proposes to the Committee member directly in charge of the area and the Committee members in charge of the department on the inspection plan and expected inspection team; proposes to the Vice Chairman of the Committee to direct the inspection team.
The Department Head submits to the Standing Committee for consideration and issuance of the inspection decision and inspection plan. The inspection team assigns tasks to members; develops an inspection schedule; and prepares necessary documents for the inspection.
Insteps: The inspection team implements the decision and inspection plan; agrees on the working schedule; requests relevant party organizations to coordinate implementation. Party members who violate the law report necessary issues and provide relevant information and documents.
After that, the Inspection Team will review the disciplinary proposal file; work with relevant organizations and individuals; examine and verify necessary contents and consider the implementation of principles, processes and procedures for disciplinary enforcement; discuss with the violating Party member about the contents that need to be added to the self-criticism (if any) and relevant Party organizations about the implementation of principles, processes and procedures for disciplinary enforcement (if any).
In case of discovering new violations or needing to adjust or supplement the inspection subjects or members of the inspection team, the head of the inspection team shall report to the Standing Committee of the Committee for consideration and decision.
The inspection team discussed with the party organization and proposed disciplinary action on the violations and discrepancies between the party organization's conclusion and the investigation and verification results to further clarify the party member's violations.
Based on the verification results, the Inspection Team completes the report proposing disciplinary action, reports to the Vice Chairman of the Committee to direct the Inspection Team before submitting to the Committee. In case the violation falls under the disciplinary authority of the Committee, the Committee representative will listen to the violating Party member's opinion before submitting to the Committee.
Final step: The inspection team reports and proposes disciplinary action; fully presents the opinions of the violating party member and the relevant party organization. The violating party member presents a self-criticism, self-accepts the disciplinary measure; the representative of the party organization managing the violating party member presents his/her opinion.
The Central Inspection Commission discusses, concludes, votes on the decision to impose discipline or proposes to the competent authority to impose discipline on the violating party member. The representative of the Commission and the inspection team announces the disciplinary decision to the party member and the relevant party organization.
