Clarifying the responsibility of leaders for violations in the management and use of public assets
((Baonghean.vn) - Voters in Nghe An recommend: Regarding the draft law on management and use of state assets (amended), the National Assembly needs to enhance the role of community supervision in the management and use of public assets, stipulate responsibilities and have clear sanctions for heads of agencies and units that allow violations of the law on management and use of public assets in agencies and units.
Regarding this issue (in Official Dispatch No. /UBTCNS14), the National Assembly's Finance and Budget Committee responded as follows:
The Law on Management and Use of Public Assets has been submitted by the Government to the National Assembly for comments at the 2nd session of the 14th National Assembly and is in the process of receiving comments from National Assembly Deputies and voters nationwide to complete the submission to the National Assembly for consideration and approval at the 3rd session of the 14th National Assembly.
The amendment of the Law aims to promote the achieved results, overcome the shortcomings and limitations in the management and use of state assets as prescribed in the Law on Management and Use of State Assets 2008. At the same time, it specifies the scope of public assets according to Article 53 of the Constitution, stipulates the management and use regime and determines the role of the State as the representative owner and unified manager of public assets.

Create a legal basis for strict management and economical use of public assets; prevent waste and corruption; exploit public assets reasonably and effectively, associated with mobilizing social resources together with the State to invest in development and exploitation of public assets to create financial resources to effectively contribute to socio-economic development...
Accordingly, many contents related to inspection and supervision have been drafted in the direction of clear and specific regulations. In the review report submitted to the National Assembly, the Finance and Budget Committee proposed to add regulations on community supervision of public assets through the supervision of people and media agencies on the management and use of public assets to increase transparency and efficiency.
Regarding the handling of violations in the management and use of public assets, the draft Law stipulates that acts causing damage to public assets must be compensated to the State. Depending on the nature and severity of the violation, those who violate the law on the management and use of public assets will also be subject to disciplinary action, administrative sanctions or criminal prosecution in accordance with the provisions of law.
At the same time, the head of an agency, organization or unit is responsible for explaining and must bear joint responsibility if there is a violation of the law on management and use of public assets in his/her agency, organization or unit; depending on the severity, he/she will be subject to disciplinary action or criminal prosecution in accordance with the provisions of law.
In response to voters’ opinions, the Finance and Budget Committee will coordinate with the drafting agency to review the provisions in the Draft Law to clarify the responsibilities and powers of leaders in the management and use of public assets. At the same time, more attention will be paid to specific regulations on monitoring activities, enhancing the role of community monitoring in the management and use of public assets.
