The Department of Overseas Labor Management (Ministry of Labor, War Invalids and Social Affairs) has just issued an official dispatch announcing changes in sending Vietnamese workers to work in Malaysia starting from October.

According to a report by the Vietnam Labor Management Board in Malaysia, the Malaysian Immigration Department has announced that employers are responsible for welcoming foreign workers into Malaysia.

From October 1, employers must come directly to carry out procedures to welcome foreign workers entering the country, not through a brokerage company. The time to welcome foreign workers entering Malaysia at the two airports KLIA and KLIA 2 will be shortened from 24 hours to 6 hours from the time the workers enter Malaysia.

If the employer fails to pick up the worker within 6 hours of the worker's entry into Malaysia, the worker will be forced to return to the departure point.

To ensure the legitimate rights and interests of workers, the Department of Overseas Labor Management requires businesses providing services to send workers to work in Malaysia to urgently contact brokerage companies and employers in Malaysia to agree on flights, arrival times at KLIA or KLIA 2 airports and pick up Vietnamese workers in accordance with Malaysian regulations.

Regarding the new regulations on sending workers to work in Malaysia, the Department of Overseas Labor Management also requires businesses to review and adjust the content of contracts sending workers to Malaysia to comply with the Memorandum of Understanding on recruitment and employment between Vietnam and Malaysia, which was signed in August.

The labor contract model under the recently signed Memorandum of Understanding stipulates specific responsibilities of the employer, Malaysian brokerage company, employee and Vietnamese enterprise, and regulations on salary and working time.

In particular, the model contract stipulates that employees have the right to keep their passports and personal documents. These are important bases to better protect the legitimate rights and interests of Vietnamese workers working in Malaysia.

The Vietnamese Government and the Malaysian Government signed a Memorandum of Understanding on labor cooperation in 2003. To date, Vietnam has sent over 220,000 workers to work in this labor market, contributing to reducing the annual pressure on job creation in the country, helping to eliminate hunger and reduce poverty for workers in rural, remote and isolated areas.
