Seeking feedback on the draft Law on Mediation at the Grassroots Level

(Baonghean.vn) -In accordance with the National Assembly's 2013 legislative program, this morning (April 25th), the Nghe An National Assembly delegation held a conference to gather feedback on the draft Law on Mediation at the Grassroots Level. Attending the conference were leaders from several provincial departments and agencies, the Fatherland Front Committees of districts, cities, and towns, and collaborators in the legislative drafting process.

The draft Law on Grassroots Mediation consists of 5 chapters and 29 articles. The scope of the Law on Grassroots Mediation covers minor legal violations and disputes at the grassroots level, such as: conflicts and disagreements between individuals; disputes over legitimate rights and interests between parties at the grassroots level arising from civil law, land, marriage and family law; and legal violations that, according to the law, do not warrant criminal prosecution or administrative penalties…

At the conference, delegates acknowledged that the enactment of the Law on Mediation at the grassroots level is necessary; its implementation will reduce the number of complaints, prevent and limit legal violations; contribute to the dissemination and education of law, raise awareness of law compliance among the people and maintain social order; and promote the moral values ​​and fine traditions in families, clans, and communities of Vietnamese ethnic groups. Delegates focused their discussions and provided feedback on the following issues: regulations for mediators; the need for clearer and more inclusive standards for mediators and mediation teams; the need to exclude a time limit for mediation, as many simple cases can be resolved quickly, while complex cases may take several years; the requirement for a mediation record; the role and responsibilities of the Vietnam Fatherland Front at all levels; and policies on grassroots mediation.

Regarding other fundamental issues, the delegates generally agreed with the draft. Concluding the meeting, Mr. Pham Van Ha, Deputy Head of the Provincial National Assembly Delegation, highly appreciated the delegates' contributions to the draft law and promised to compile the opinions and present them at the next National Assembly session.
