According to the indictment, at 4:00 p.m. on May 17, 2019, Thanh, along with Mr. Vu Van Hung (born in 1965, residing in the same hamlet) and two other men were repairing an excavator for their family on the inter-village road.
At this time, Mr. Nguyen Tat Dat (born in 1981, residing in Xuan Duong hamlet, Tan Xuan commune, Tan Ky district) also drove an excavator past and stopped where Thanh and everyone else were repairing the machine.
Thanh asked: "Where are you going?" Dat replied: "I'm going to work for Mr. Thieu." Angry at Dat's answer, Thanh picked up a knife and ran back to Dat's excavator but was held back by Mr. Hung.
Thanh then picked up a rock on the side of the road and threw it through the door of the excavator where Dat was sitting. Dat suffered a wound on the inner front of his right leg.
Afterwards, Mr. Dat submitted a request for injury assessment and requested the initiation of a criminal case. The Investigation Police Department of Tan Ky District Police conducted a request for assessment of Mr. Nguyen Tat Dat's injury rate to be 1%.
At the end of the trial, the panel sentenced Thanh to 9 months in prison and ordered him to pay Mr. Dat 12 million VND in compensation.
