Abusing the village chief's authority to forge contracts
Taking advantage of his position as a member of the working group serving the investment, construction and upgrading project of the pumping station, village chief Le Tuan Sang forged two contracts.
Recently, the Hanoi People's Court brought defendant Le Tuan Sang (38 years old, residing in Hoang Long commune) - former head of Thanh Xuyen village, Hoang Long commune, Phu Xuyen district, Hanoi to the appeal trial for the crime of Forgery in work.
According to the first instance verdict, on April 1, 2011, Sang was elected village chief. Seven months later, taking advantage of his position as a member of the working group serving the investment, construction and upgrading project of Dao Xa pumping station, Hoang Long commune, Sang arbitrarily changed the time of two contracts so that the contractor could receive compensation and support for site clearance.

According to the first instance verdict, Sang had photocopied two copies of the contract. Before photocopying, the village chief had altered the contract execution time.
On December 27, 2011, Sang brought these contracts to the People's Committee of Hoang Long Commune for certification. Then, Sang brought 2 certified copies to submit to the Land Clearance Board of Phu Xuyen District.
With the above contract, the project investor received more than 240 million VND in compensation and support. Discovering the violations, the Land Clearance Committee recovered nearly 220 million VND from the project investor.
Sang confessed that because of his relationship with the investor's family, he made the repairs himself to increase the time and receive more money.
Before being prosecuted, Sang had been disciplined by the Party and the government. Sang accused that the investor had received the support money and that there were many other individuals who had committed violations but were not punished... The village chief was not subject to the regulation of corruption crimes, so the prosecution was incorrect, the defendant was wrongly accused and did not commit a crime.
Considering that the defendant's act of self-correcting the above two contracts constitutes the crime of Forgery in work, the court of first instance sentenced Sang to 3 years in prison. Sang appealed.
Considering Sang's appeal, the Hanoi People's Court held that the defendant's actions violated the proper functioning and reputation of the State administrative agency.
However, the defendant did not seek personal gain. Although the defendant continued to deny his actions, the appellate court held that there was sufficient evidence to convict Sang of the crime, so it did not accept the appeal and upheld the original judgment./.
