Penalty for wearing headphones while driving
Headphones are a popular type of audio device that is compact and easy to carry when traveling. However, the sound emitted from this device can distract the listener, affecting their observation and movement on the road. Therefore, wearing headphones is prohibited when participating in traffic.
According to Point C, Clause 3, Article 30 of the 2008 Road Traffic Law:"It is strictly forbidden for drivers of two-wheeled motorbikes, three-wheeled motorbikes, and mopeds to use audio equipment, except hearing aids."
Violations of wearing headphones while driving a vehicle will be punished according to Point h, Clause 4, Article 6 of Decree 100/2019/ND-CP amended and supplemented by Decree 123/2021/ND-CP as follows:
- Fine from 800 thousand to 1 million VND for driving a vehicle using an umbrella, mobile phone, audio device, except hearing aids.
- In addition to being fined, drivers wearing headphones will also have their driver's license revoked for 1 - 3 months.
Is it illegal to wear headphones but not use them?
If a driver wears headphones while driving but does not use them, he or she will not be in violation of traffic laws. However, if the traffic police detect that the driver is wearing headphones, the driver must prove that he or she is not using them to listen to music or make a phone call at that time.
Although not a violation, to ensure safety, it is best for people not to wear headphones while driving. When using the phone, stop the car, pull over to the side of the road, and only answer the phone when it is safe.
