Two friends "progressing together"
One day in mid-April, Dao Huu Phu (36 years old), residing in Phong Thinh commune, Thanh Chuong district, was brought to trial for the crime of “Illegal trading of narcotics”. Meanwhile, his accomplice Nguyen Ngoc Nam (40 years old), residing in Thanh Hoa commune, Thanh Chuong district, was prosecuted for the crime of “Illegal transportation of narcotics”.drug”. Also involved in the case is defendant Dau Dinh Son (39 years old), residing in Thanh Lam commune, Thanh Chuong district, who was prosecuted for the crime of “Failure to report a crime”.
This is the second time Phu has appeared in court. Previously, in 2015, Phu was sentenced to 33 months in prison for illegal possession of narcotics. After being released from prison, he did not have a stable job but Phu showed many signs of financial and time irregularities that the authorities noticed.
Not inferior to his friend, Nguyen Ngoc Nam also had many previous convictions before being involved in this drug trafficking case. Accordingly, in 2003, Nam was sentenced to 2 years in prison for illegal possession of drugs. 3 years later, Nam received a 7-year prison sentence for two crimes of theft. After being involved in drugs and theft, Nam got involved in gambling and was sentenced by Thanh Chuong District Court to 30 months in prison for gambling.
After many times of “eating prison food and wearing numbered uniforms”, Nam still has not turned around, focused on making a living or finding a stable home for himself. Instead, this young man has participated in transporting a large amount of drugs for Phu.

Regarding the case, around mid-April 2021, Dao Huu Phu contacted a Laotian (unknown origin and address) to order more than 7.4 kg of various drugs to sell for profit. To have money to buy drugs, Phu borrowed a friend's car and pawned it. After that, Phu transferred a total of 400 million VND 5 times to a person in Laos to buy "goods".
On the afternoon of April 23, 2021, at his own home, Phu asked Nguyen Ngoc Nam to go to the Cau Treo border gate area (Ha Tinh) to pick up drugs and bring them back. Phu promised to pay 50 million VND, Nam agreed to transport the drugs.
At around 9:30 a.m. on April 26, 2021, Phu rented a car and gave it to Nam to drive to the border gate to get the drugs. After receiving the drugs from the Laotian, Nam put them in the car and turned back to Nghe An. At 12:45 p.m. the same day, while Nam was traveling through Ha Tinh, he was arrested by the police with the evidence.
During the time Nam went to get drugs, Son drove Phu to Ha Tinh. When they reached Son Tay commune, Huong Son district, Dao Huu Phu saw the police force so he quickly turned the car around and ran into the cemetery to hide. At this time, Phu called his girlfriend to inform her that Nam had been arrested. At the same time, he instructed his girlfriend to open the safe and take out the package of drugs to dispose of. Following Phu's instructions, his girlfriend put the drugs in the toilet and flushed them away. As for Phu and Son, after a period of hiding in the cemetery, they were arrested by the police.
The investigation agency determined that Dau Dinh Son was the one who knew Phu was illegally buying and selling drugs in large quantities, but when the police brought him to the headquarters to investigate the matter, he did not report Phu's crime. On April 29, 2021, Son turned himself in for not reporting Phu's drug trafficking.
The man who denied his guilt was still sentenced to death.
At the trial, the two defendants Son and Nam admitted to committing the crimes as charged in the indictment. Nam admitted that he agreed to go to Ha Tinh to get drugs for Phu because he was greedy for the 50 million VND reward. This defendant stated that he followed all of Phu’s instructions and asked the court to give him a chance to live.

Meanwhile, defendant Phu did not admit to buying and selling drugs from Lao people. Phu said he did not have a job so he did not have money to buy drugs. However, when asked by the jury about text messages about borrowing money, transferring money to Lao people... the defendant gave a evasive statement. Phu steadfastly denied buying and selling drugs even though defendant Nam admitted to transporting drugs for Phu.
The panel of judges determined that although the defendant Phu did not admit to drug trafficking, based on his self-confession, the minutes of his testimony, the minutes of his arrest, the statements of the defendants and other documents and evidence that had been examined, there was sufficient basis to conclude that the defendant Dao Huu Phu had committed the act of illegal drug trafficking as charged in the indictment. The defendant had traded an exceptionally large quantity of drugs and therefore needed to be dealt with severely. Therefore, the court sentenced Dao Huu Phu to death.
The highest sentence was also given to defendant Nguyen Ngoc Nam for the crime of Illegally transporting narcotics. Defendant Dau Dinh Son received a 24-month prison sentence for Failure to report a crime.
