In 2025, will traffic police be required to report violations when stopping vehicles for inspection? This is a matter of concern for Mr. Tran Minh Hieu (Nghi Loc, Nghe An).

Reply: Pursuant to Article 66 of the Law on Road Traffic Order and Safety 2024, Traffic Police are allowed to stop vehicles participating in road traffic for inspection and control when there is one of the following grounds:

- When detecting a violation of the law or having grounds to determine that there is a violation of the law on road traffic order and safety or other violations of the law;

- Comply with orders and patrol and control plans of competent authorities to detect violations of laws on road traffic order and safety that require stopping vehicles for inspection and control;

- Serving national security protection, ensuring social order and safety and fighting against crime; preventing and combating natural disasters; preventing and fighting fires and rescuing; preventing and combating epidemics;

- There are reports, denunciations, reflections, recommendations, and requests from agencies, organizations, and individuals about crimes and other violations of the law.

And according to the provisions of Clause 3, Article 14 of Circular 73/2024/TT-BCA, it is stipulated that:

Conduct control.

When the vehicle to be controlled has stopped at the location as instructed, the Traffic Police officer assigned to control the vehicle shall stand at a suitable and safe location and perform the following:

...

3. Notify the vehicle driver of the basis for stopping the vehicle for inspection and control; the content of the control; request the vehicle driver to present relevant documents as prescribed in Clause 1, Article 8 of this Circular for control as follows:

a) In case the vehicle driver or vehicle owner presents information of documents that have been integrated and updated in the electronic identification account on the National Identification Application, in the database managed and operated by the Ministry of Public Security, the inspection and control shall be carried out through the information in the electronic identification account on the National Identification Application and the database;

Thus, when traffic police stop a vehicle for inspection or control, if they detect a violation or determine that there is a violation, they will notify the violator.

However, in case the traffic police stop a vehicle based on the remaining grounds as prescribed above, it is not necessary to report the traffic violation of the participant.
