(Baonghean.vn) - Stealing 2 pairs of hens worth only 500,000 VND, Phan Van Kieu was sentenced by the People's Court of Do Luong district to 6 months in prison because he had previously been administratively punished for stealing chickens but had not had his criminal record cleared.

On October 28, Do Luong District People's Court opened a first-instance criminal trial to try defendant Phan Van Kieu (born 1991), residing in Hamlet 6, Da Son Commune, Do Luong District, for the crime of "Theft of property"According to the provisions of Clause 1, Article 173 of the Penal Code, the incident occurred in Xuan Son commune, Do Luong district.

According to the indictment, at about 10:30 a.m. on September 13, 2022, Phan Van Kieu had a previous conviction for theft of property because on June 3, 2022, Kieu was administratively fined 2,500,000 VND by the Chairman of the People's Committee of Da Son commune, Do Luong district, also for stealing "chickens", driving a motorbike to Cuoi village in Xuan Son commune, Do Luong district to catch bees, but there were none, so Kieu went home.

Because he was a drug addict, on the way home, Kieu thought of a way to get money to buy drugs to use. When passing by the chicken farm of Mr. Son's family, residing in Hamlet 4, Xuan Son Commune, Phan Van Kieu discovered a flock of grown chickens of Mr. Son's family and had the idea of ​​stealing chickens. Thinking and doing, Kieu immediately used a sack and a bamboo stick to herd 4 hens of Mr. Son's family and put them in the sack. Kieu then brought the 4 stolen chickens to an abandoned house to wait for an opportunity to sell them.

However, when he returned home and realized his actions, on the afternoon of September 13, 2022, Phan Van Kieu brought the sack containing the four stolen chickens to the Xuan Son Commune Police Station, Do Luong District to surrender and report his theft of property.

Regarding his criminal behavior, before the trial, defendant Phan Van Kieu honestly confessed his crime. Because he was addicted to drugs and had no stable job, he committed such petty thefts.

According to the Trial Council, Phan Van Kieu’s actions did not constitute theft because the value of the property was only 500,000 VND. However, because Kieu had just been administratively punished for stealing chickens, and therefore had a criminal record that had not been cleared, the Trial Council sentenced defendant Phan Van Kieu to 6 months in prison.
