Four days ago, Ms. Phan Thi Nghia was prosecuted by Vinh City Police for the crime of Humiliating Others but was released on bail.
Lawyer Nguyen Trong Hai - Head of Trong Hai and Associates Law Firm said that for this crime, according to regulations, if there is an agreement and reconciliation between the two parties, and the victim then withdraws the request for prosecution, the police investigation agency can issue a decision to suspend the investigation and suspend the prosecution of the accused.
“In the event that the victim has requested prosecution but then withdraws the request before the opening date of the first instance trial, the case must be suspended,” said lawyer Hai, adding that the authority to decide whether to suspend or not still depends on the assessment of Vinh City Police. “If the police investigation agency believes that this behavior is serious, it may not be suspended.”
Vinh City Police have not yet made a statement about this action of the victim.
