Improving the effectiveness of social insurance inspection work: Protecting the legitimate rights and interests of workers

Specialized surprise inspections at 364 labor-using units

In order to reduce evasion, late payment and prevent violations of the law on social insurance and health insurance, in 2022, the Provincial Social Insurance has completed the inspection and examination targets according to the Plan, including completing inspections at 12 collection agents and payment representatives; specialized inspections at 275 labor-using units; Completed inspection targets and conducted inspections at 20 health insurance examination and treatment facilities.

In addition, the Provincial Social Insurance has conducted surprise specialized inspections at 364 employers who have committed acts of evading payment or delaying payment for more than 3 months; surprise specialized inspections at 33 employers assigned by the Vietnam Social Insurance in Official Dispatch No. 3428 dated November 11, 2022; established 04 inspection teams to conduct surprise inspections of 04 health insurance medical examination and treatment facilities that have increased the cost of health insurance medical examination and treatment.

Besides the units and enterprises that try to overcome difficulties and implement social insurance and health insurance policies well, there are still many units and enterprises that are slow to pay, avoid paying, or do not pay enough for the number of employees eligible to participate, affecting the rights of employees. The provincial Social Insurance has coordinated with relevant agencies and units to strengthen inter-sectoral inspection and examination; urging units and enterprises to strictly implement the provisions of the law on social insurance and health insurance. After urging, inspecting, and examining, many enterprises with large debts have recovered all of their debts.

In 2022, through inspection and examination work, Nghe An Provincial Social Insurance discovered 204 employees who were required to participate in social insurance, health insurance, and unemployment insurance but had not participated or had participated but did not have enough time, with the amount of money requested to be paid back more than 1.57 billion VND; Discovered 23 employees who paid below the prescribed level and requested to pay back 548 million VND; Recovered 81.4 billion VND of social insurance, health insurance, and unemployment insurance debt at employers;...

Mr. Tran Van Phuong - Head of the Inspection and Examination Department of Nghe An Social Insurance said: Immediately after issuing the Inspection and Examination Plan for 2022, the Provincial Social Insurance proactively made plans for each month and each quarter to implement; Actively coordinated with the Provincial Department of Labor - Invalids and Social Affairs, the Provincial Police Investigation Agency, the District Department of Labor - Invalids and Social Affairs... to conduct inter-sectoral inspections and examinations to prevent and handle violations of the law on social insurance, health insurance, and unemployment insurance to ensure the rights and interests of employees.

Nghe An Provincial Social Insurancehas actively implemented surprise specialized inspections according to Official Dispatch No. 326/BHXH-TST dated February 9, 2022 and Official Dispatch No. 3428/BHXH-TTKT dated November 11, 2022 of Vietnam Social Security. The inspection process has effectively applied solutions and initiatives to streamline inspection and examination activities, bringing high efficiency and shortening working time. Through professional skills before the inspection, such as directly contacting by phone to urge and grasp the situation at the unit, disseminating the rights and benefits of social insurance participants, sanctions, etc., has effectively impacted the work of collecting social insurance, unemployment insurance and health insurance debt.

Synchronously deploy multiple solutions

In addition to direct inspection and examination at units, Nghe An Social Insurance also deploys a variety of measures to ensure the effectiveness of inspection and examination work such as: Inviting units with social insurance, health insurance, and unemployment insurance debts to work at the Social Insurance agency with the participation of the investigation agency (Economic Police Department of the Provincial Police) to urge units to fulfill their social insurance payment obligations and disseminate legal regulations and sanctions for violations.

According to the leaders of Nghe An Social Insurance, through the working sessions, businesses have been very active in sharing and exchanging information to work towards the goal of social security for workers in the area. The Social Insurance Agency will accompany and support businesses to create more favorable conditions in learning and effectively implementing social insurance and health insurance policies and regimes.

In 2023, Nghe An Provincial Social Insurance will continue to closely follow the direction of the Government and Vietnam Social Insurance on inspection and examination work in the context of "safe, flexible adaptation, effective control of the Covid-19 epidemic" and the actual situation in the locality to promptly advise on flexible solutions to implement appropriate inspection and examination work. At the same time, innovate inspection and examination work, improve the quality, effectiveness and efficiency of inspection and examination work to ensure objectivity, accuracy, timeliness and strictness, focusing on topical contents of the industry such as inspection and examination of contributors, beneficiaries, and support packages from social insurance funds and unemployment insurance according to the Government's Resolution. It is expected that in 2023, specialized inspections will be carried out at 240 units, interdisciplinary inspections at 55 units, inspections at 20 health insurance examination and treatment facilities and 70 labor-using units...
