Cooking and selling alcohol must be registered for business.
The Government has just issued Decree 105/2017/ND-CP regulating alcohol trading.
This Decree regulates alcohol business activities, including: Production, import, distribution, wholesale and retail of alcohol; and on-site alcohol sales.

Alcohol trading is included in the list of conditional investment and business sectors. Organizations and individuals producing industrial alcohol, producing artisanal alcohol for business purposes, distributing alcohol, wholesaling alcohol, retailing alcohol, and selling alcohol for on-site consumption must have a license as prescribed in this Decree. Organizations and individuals producing artisanal alcohol to sell to enterprises with an industrial alcohol production license for reprocessing must register with the People's Committee at the commune level.
Wine that has technical regulations must be declared to comply with regulations and the declaration of conformity must be registered with the competent state agency before being circulated on the market.
Wine that does not have technical regulations must be declared in accordance with food safety regulations and the declaration of compliance with food safety regulations must be registered with the competent state agency before being put into circulation on the market until the corresponding technical regulations are issued and come into effect.
Procedures for declaring conformity and declaring compliance with food safety regulations are prescribed by the Law on Food Safety, the Government's Decree detailing the implementation of a number of articles of the Law on Food Safety and other relevant current legal documents.
Wine produced for domestic consumption and imported wine must be stamped and labeled according to regulations, except for wine produced by hand for sale to enterprises with an industrial wine production license for reprocessing; imported semi-finished wine does not need to be stamped.
The Decree clearly stipulates acts of violating the provisions of the law on alcohol trading, including: Trading alcohol without a license or not in accordance with the contents stated in the license as prescribed in this Decree; using food alcohol that does not meet standards, industrial alcohol or other prohibited ingredients to produce or mix alcohol; renting or lending an Alcohol Trading License; displaying, buying, selling, circulating or consuming alcohol without stamps or labels in accordance with the law, alcohol that does not ensure standards, quality or food safety, alcohol of unclear origin; selling alcohol to people under 18 years old, selling alcohol with an alcohol concentration of 15 degrees or more over the Internet, selling alcohol through vending machines; advertising or promoting alcohol in violation of the law.
The Decree takes effect from November 1, 2017.
