On the morning of May 25, implementing the agenda of the 3rd session of the 14th National Assembly, Member of the National Assembly Standing Committee, Chairman of the National Assembly Economic Committee Vu Hong Thanh presented a Report explaining the acceptance and revision of the draft Law on Planning. Delegates attending the session discussed in the hall a number of contents with different opinions of the draft Law on Planning.

Delegate Nguyen Sy Hoi, Major General, Deputy Commander of Military Region IV, National Assembly Delegation of Nghe An province, gave some opinions on national marine spatial planning. In Article 24 of the draft Law on Planning, Delegate Nguyen Sy Hoi said that the content of the provisions on the field of National Defense - Security is not specific:

“Article 5, Clause 3 affirms that the national master plan includes national marine spatial planning, national land use planning, and national sectoral planning. Thus, the law has identified the national legal planning system as consisting of 3 areas. In the explanation and orientation of the National Assembly Standing Committee, it is affirmed that the marine space is an open space related to many areas, especially security and defense. However, Article 24 has 3 clauses, the content of the clauses on the field of defense and security is not specific. In Clause 2, Point b only mentions very generally. The area that needs special protection for the purpose of defense and security, in my opinion, is not satisfactory.”

Commenting on Article 64, delegate Nguyen Sy Hoi said that no agency has been found responsible for marine spatial planning.

“Article 64 on the duties and powers of ministries and ministerial-level agencies, this article has 5 clauses. Clause 1: Duties and powers of the Ministry of Planning and Investment. As I understand it, this is the central agency, the conductor. Clause 2: Duties and powers of ministries and ministerial-level agencies. This clause stipulates the state management responsibilities of ministries and ministerial-level agencies and the coordination responsibilities between agencies. Clause 3: Duties and powers of the Ministry of Construction on urban and rural planning. Clause 4: Duties and powers of the Ministry of Natural Resources and Environment on land use planning. Clause 5: Ministry of Finance mobilizes resources…

I have not seen any agency responsible for marine space. Regarding the field of marine space planning, the content related to national defense and security has not been mentioned, only the planning of the national seaport system established by the Ministry of Transport and 2 plans established by the Ministry of National Defense, which are planning for national defense land, planning for national defense works, and ammunition depots. Thus, marine space planning, including content serving the field of national defense and security, is still open. In short, in the 3 areas of task identification and responsibilities, the law has not mentioned it yet."

According to delegate Nguyen Sy Hoi, this bill should have 1 article or 1 clause in the marine spatial planning that closely combines socio-economic development with national defense and security. And in article 64, there is 1 clause on the agency responsible for presiding over the marine spatial planning. The structure and capacity should be studied by the drafting agency.

The Deputy Commander of Military Region IV said that "Our country is in the integration period, expanding the exploitation of resources on the mainland and islands is necessary. However, if the current national master plan is not carefully prepared and fundamentally calculated; key areas of national defense and security are all developed into industrial parks and factories; or ports and bays are all joint ventures, associations, and privatization, then we and our descendants will face difficulties in the task of protecting the Fatherland, especially the national defense strategy from the sea.
