Court date of former Director of Hanoi Heart Hospital Nguyen Quang Tuan
On April 17, the Hanoi People's Court will open the first-instance trial of the bidding violation case that occurred at the Hanoi Heart Hospital.
Judge Nguyen Xuan Van presided over the trial. The panel summoned the civil plaintiff, Hanoi Heart Hospital, and parties with related obligations and interests, including AIC Vietnam Investment and Valuation Joint Stock Company, and two other individuals.
There were more than 10 lawyers participating in defending the defendants, including 2 lawyers defending Mr. Nguyen Quang Tuan.
12 people were brought to trial for the crime of "Violating bidding regulations causing serious consequences". The defendants are: Nguyen Quang Tuan (born in 1967, former Director of Bach Mai Hospital), Hoang Thi Ngoc Huong (born in 1961, former Deputy Director of Hanoi Heart Hospital), Nguyen Thi Dung Hanh (born in 1969, former Chief Accountant, Head of Finance and Accounting Department of Hanoi Heart Hospital), Doan Trong Binh (born in 1960, former Deputy Head of Medical Supplies Department of Hanoi Heart Hospital);
Nghiem Tuan Linh (born in 1980, former Deputy Head of Medical Supplies Department, Hanoi Heart Hospital); Nguyen Duc Dang (born in 1976, Chairman of the Board of Directors of Hoang Nga Medical Equipment Joint Stock Company), Phan Tuan Dat (born in 1967, former Chairman of the Board of Directors, Deputy Director of Kim Hoa Phat Biotechnology Joint Stock Company), Pham Huy Lap (born in 1952, Director of Hoang Nga Company), Pham Thi Kim Oanh (born in 1981, Chief Accountant of Hoang Nga Company);
Tran Phu Hung (born in 1976, Deputy General Director of AIC Vietnam Investment and Valuation Joint Stock Company), Nguyen Hong Dung (born in 1982, Deputy General Director, Appraiser of AIC Valuation Company), Nguyen Trung Dung (born in 1989, appraiser of AIC Valuation Company).

According to the indictment, since 2015, Mr. Nguyen Quang Tuan (then Director and Chairman of the Hanoi Heart Hospital's Purchasing Council) had a policy of allowing a number of businesses to consign supplies for the hospital to use in advance. Afterwards, Mr. Tuan directed his subordinates to legalize and complete procedures for the winning businesses to make payment.
Due to their previous acquaintance, Nguyen Duc Dang (Chairman of the Board of Directors of Hoang Nga Company) and Phan Tuan Dat (Chairman of the Board of Directors of Kim Hoa Phat Company) came to discuss the matter and Mr. Tuan agreed to allow the two companies to sell cardiovascular intervention consumables to the hospital at the unit price agreed between Mr. Tuan, Mr. Dang and Dat.
In 2016-2017, Hanoi Heart Hospital organized separate bidding packages specializing in purchasing cardiovascular intervention consumables, with a total value of more than 595 billion VND.
Hoang Nga Company participated and won 5 bids, Kim Hoa Phat Company won 4 bids.
To legalize the bidding documents for purchasing cardiovascular intervention consumables of Hoang Nga Company and Kim Hoa Phat Company, Mr. Tuan and other defendants took advantage of their positions and powers to illegally intervene in bidding activities.
According to the accusation, the defendants, former officials at Hanoi Heart Hospital, colluded with other defendants to issue a Certificate of Price Appraisal as requested and the fixed price of Hanoi Heart Hospital in the 2016 procurement plan approved by Mr. Nguyen Quang Tuan, ensuring that Hoang Nga Company and Kim Hoa Phat Company won the bid and sold medical supplies in violation of regulations.
This caused a loss of more than 22.8 billion VND to Hanoi Heart Hospital and the Social Insurance Fund for package number 5 in 2016.
In 2017, Mr. Tuan and his accomplices continued to legalize the bidding procedures for 4 shortened bidding packages, using the unit price of materials from the 2016 bidding package to pay for consigned goods and pre-used goods for Hoang Nga Company, Kim Hoa Phat Company and a number of companies that sent goods in advance, causing damage to Hanoi Heart Hospital and the Social Insurance Fund of more than 30 billion VND.
According to the Supreme People's Procuracy, the criminal acts of Mr. Tuan and his accomplices were concluded by the Supreme People's Procuracy to have caused a loss of 53.6 billion VND.
The trial is scheduled to last five days.
