Nghe An issues Directive to improve the quality of work in drafting and promulgating legal documents

(Baonghean.vn) - Nghe An Provincial People's Committee has just issued Directive No. 25/CT-UBND dated September 13, 2023 on continuing to improve the quality of drafting and promulgating legal documents in the province.

Directive No. 25/CT-UBND clearly states: In recent times, with the attention of Party committees, authorities, and the coordination of the Fatherland Front, agencies, departments, branches, and socio-political organizations from the province to the grassroots level, the work of building and promulgating legal documents (QPPL) and organizing law enforcement in the province has achieved many important results. Nghe An province has built a relatively synchronous and increasingly complete system of QPPL documents, promoting the regulatory role in the field of social life, promptly concretizing the Party's guidelines and policies, the State's policies and laws, contributing to promoting socio-economic development, maintaining political stability, ensuring national defense and security in the province.

However, in addition to the achieved results, the work of drafting legal documents in the province still has limitations and shortcomings: Some documents have not yet ensured consistency and stability; some regulations are not suitable for practical requirements and difficult to apply; the situation of slow promulgation of legal documents with detailed regulations for implementation has not been thoroughly resolved; the organization of law enforcement in some places is still confusing and ineffective; awareness of law compliance among a number of cadres and people is still low....

The above limitations and shortcomings stem from many causes, but mainly due to the inadequate awareness, consciousness and responsibility of some agencies, units and leaders; the lack of strict compliance with discipline in drafting legal documents; the lack of close and effective coordination; the drafting and implementation of documents are not really cohesive; the number of direct staff is still small, and their capacity is not commensurate with the requirements of the task; resources for drafting and enforcing laws have not met practical requirements.

To improve the quality of work on building and perfecting the system of legal documents and enhancing the effectiveness of law enforcement in the province, meeting the requirements and tasks in the new situation, the Provincial People's Committee requests:

*Director of thelive, Heads of provincial departments and branches; ChairmanUPeople's Committees of districts, cities and towns:

- Have solutions to raise awareness and consciousness about the position, role and importance of law-making and law enforcement; identify this as an important task that needs to be prioritized in leadership, direction and administration to focus intelligence and resources; link law-making with law enforcement. Heads of departments, branches and sectors; Chairmen of district-level People's Committees directly direct and are responsible to the Provincial People's Committee and the Chairman of the Provincial People's Committee for the work of drafting legal documents of their departments, branches and localities.

- Closely follow the Resolutions of Party Congresses at all levels, the Party's guidelines and policies, the State's policies and laws, and practical requirements of localities to identify priority areas for developing mechanisms and policies, focusing on attracting investment, administrative reform, creating favorable conditions for people and businesses, strengthening decentralization and delegation of power associated with effective resource mobilization, improving policy implementation capacity, and at the same time solving practical problems that arise, removing difficulties and obstacles to build a complete, synchronous, timely, and feasible system of documents, creating momentum for socio-economic development for localities.

- Strictly comply with the process and procedures for issuing legal documents in accordance with regulations. Improve the quality of drafting, commenting, appraising, and collecting opinions from affected subjects, ensuring the mechanism for people to participate in mechanisms and policies. Seriously receive, fully and substantively explain comments to ensure feasibility. Focus on summarizing and concluding law enforcement, assessing policy impacts and communicating policies to create consensus, especially for specific policies. Have methods of inspection, supervision, and control, not to be dominated by group interests and sectoral interests in the development and implementation of mechanisms and policies.

- Strengthening discipline and order in the work of drafting legal documents. Clearly assigning responsibilities to each unit and individual in researching, drafting, proposing policies and drafting and submitting legal documents. Thoroughly overcoming the situation of slow and unpaid documents; limiting the issuance of legal documents outside the program. The results of this activity are considered one of the criteria for assessing the level of task completion and administrative reform, and are the criteria for considering emulation and commendation titles for relevant agencies, units and individuals, especially the leaders.

- Strengthen coordination, promote the role and sense of responsibility, especially the drafting agency and the appraisal agency. Provincial and local departments, branches and sectors coordinate more closely, proactively and responsibly with the Department of Justice, the Provincial People's Committee Office, and specialized agencies of the Provincial People's Council.

- Improve the efficiency and effectiveness of law enforcement organizations, specifically:

+ Focus on innovating the methods of disseminating, propagating, and thoroughly grasping the Party's guidelines and policies, the State's policies and laws in general, and its own legal documents in particular, creating strong changes in awareness and self-consciousness in studying, understanding and complying with the law; at the same time, identifying this as the input step in organizing law enforcement.

+ Clearly define the mechanism of assignment, coordination responsibility, and responsibility of the head in organizing the implementation of issued legal documents. Proactively disseminate, guide, and remove difficulties and obstacles in organizing the implementation of legal documents.

+ Further improve policy response capacity in the process of organizing law enforcement, especially in receiving and handling feedback and recommendations from people and businesses. Focus on dialogue with businesses and people about difficulties and inadequacies in policy and law enforcement.

+ Strengthen inspection, examination and supervision of law enforcement; detect and promptly and strictly handle individuals and organizations with shortcomings and violations in law enforcement. At the same time, promptly reward organizations and individuals with achievements in law-making and law enforcement.

- Strengthen the inspection and review of legal documents in the fields and sectors under management to handle and propose handling of conflicting, overlapping, inappropriate or impractical contents.

- Pay more attention to the arrangement and assignment of competent officials and civil servants to directly advise on the development, review, inspection and monitoring of law and legal enforcement. Strengthen training and fostering of knowledge, skills and expertise for this team. Prioritize the allocation of resources (finance, equipment) to serve the work of developing, checking, reviewing and enforcing laws.

* The Provincial People's Committee also requestedSliveJustice:

- Continue to promote the advisory role, assisting the Provincial People's Committee in State management of the work of building, promulgating, inspecting, reviewing and enforcing laws. Preside and closely coordinate with provincial and local departments, branches and sectors, research and propose to the Provincial People's Committee and Chairman of the Provincial People's Committee solutions to strengthen the work of building, inspecting, reviewing and enforcing laws in the province.

- Perform well the role of the agency appraising legal documents: Improve quality, independence and clearly express viewpoints in appraisal, do not organize appraisal of draft documents that do not meet the conditions and procedures according to regulations.

- Responsible for monitoring, urging, and inspecting the implementation of this Directive and promptly reporting to the Chairman of the Provincial People's Committee any arising problems and proposing appropriate solutions.

* Veat roomUProvincial People's Committee:

Coordinate with the Department of Justice to advise on the list of proposals for drafting resolutions to be submitted to the Provincial People's Council annually; check and review draft legal documents before submitting them to the Provincial People's Committee; coordinate with provincial departments, branches, sectors, and relevant agencies to handle issues and contents with different opinions and accept opinions of members of the Provincial People's Committee; have innovative solutions to shorten the time for submitting and issuing documents. Do not accept or submit to the Provincial People's Committee draft documents that do not meet the prescribed conditions and procedures.

The Provincial People's Committee's Directive also requires the Department of Home Affairs to coordinate with the Department of Justice, departments, branches, and localities to study and consolidate the organizational structure and staffing to carry out the work of building and enforcing laws and legal systems. The Department of Finance advises and guides the allocation of funds to ensure the work of building, inspecting, reviewing, and enforcing laws in the province in accordance with the provisions of the State Budget Law and current budget decentralization.
