Nghe An: Real estate project investors need to strictly implement planning

(Baonghean.vn) - That is one of the regulations of Nghe An Provincial People's Committee in Official Dispatch No. 5724 dated August 13 of Nghe An Provincial People's Committee to implement Directive No. 11/CT-TTg dated April 23, 2019 of the Prime Minister on a number of solutions to promote the stable and healthy development of the real estate market.

The document stated: In recent times, the real estate market in the province has had many positive changes, the investment environment has been improved, attracting many investors to implement projects, contributing to solving the essential needs of housing, urban renovation, while promoting trade activities and socio-economic development of the province. However, the real estate market in the province is still not sustainable, with many potential risks.

Some investors have not strictly implemented the provisions of the law on investment, construction and real estate business, causing difficulties in management, affecting the rights and illegal interests of customers; some organizations mobilize capital, buy and sell houses when they are not qualified, have not implemented bank guarantees, have not fulfilled financial obligations; the use of mobilized capital is not public and transparent,...

To effectively implement Directive 11 of the Prime Minister on strengthening management to ensure stability of the real estate market and to rectify and overcome the above shortcomings and limitations, the Provincial People's Committee assigned the Department of Construction to be responsible for advising the Head of the Steering Committee and the Chairman of the Provincial People's Committee to direct the implementation of the Law on Real Estate Business, the Law on Housing and other regulations related to the management, development of housing and the real estate market in the area; urgently advise the Provincial People's Committee to issue a decision approving the Housing Development Program of Nghe An province to 2025, with a vision to 2030.

The Department of Natural Resources and Environment shall coordinate with the Department of Construction and the People's Committees at the district level to supplement the planning and land use plans to ensure sufficient land fund for social housing development; strengthen guidance and direction for the People's Committees of districts, cities and towns to issue Certificates of land use rights, house ownership rights and assets attached to land to people according to regulations;... Relevant departments and branches shall, based on their functions and tasks, strictly implement the contents assigned in this Official Dispatch.

The People's Committees of districts, cities and towns shall perform state management of housing construction investment projects and real estate business projects in their localities according to their assigned functions and tasks; strengthen inspection of construction investment at real estate projects to promptly prevent and handle acts of construction that are contrary to construction planning and designs appraised and approved by competent authorities, causing difficulties in the issuance of certificates of land use rights, house ownership rights and other assets attached to land.

Along with that, guide investors of housing construction investment projects on the dossier and procedures for assessing conditions for transferring land use rights according to regulations; organize and direct the review and supplementation of urban planning and industrial park planning to ensure sufficient land fund for social housing development; strengthen inspection and examination work to promptly detect violations of the law by investors in real estate business...

For investors of real estate business projects in the province, strictly implement planning, strictly implement the Law on Real Estate Business, Housing Law, Construction Law, Land Law and other relevant Laws; do not apply forms of capital mobilization such as capital contribution, investment cooperation, business cooperation,... of organizations, households, individuals or other forms of capital mobilization to divide housing products or to prioritize registration, deposits,...

Real estate transactions in the province must strictly and fully comply with the provisions of Article 26 of Circular No. 11/2015/TT-BXD dated December 30, 2015 of the Ministry of Construction; advertise and sell products in accordance with the design and planning of the project approved by competent authorities and the provisions of law on advertising.
