Nghe An proactively rearranges the position of Vice Chairman of the Commune People's Committee according to regulations

Surplus due to implementation under new Law and Decree
In fact, up to now, the appointment, rotation, and transfer of cadres at all levels of Party committees and authorities must ensure compliance with regulations, guidelines, decrees, and circulars of the Party and State. And the appointment or rearrangement of the position of Vice Chairman of the People's Committee at the commune, ward, and town levels is no exception.

During the 2011-2016 term, the appointment of vice chairmen of commune-level People's Committees in Nghe An was carried out in accordance with Decree 107/2004/ND-CP of the Government stipulating the number of vice chairmen and the structure of People's Committees at all levels. Accordingly, the People's Committees of mountainous and island communes with a population of 5,000 or more, and plain and midland communes with a population of 8,000 or more will be assigned 2 vice chairmen.
However, in the 2016 - 2021 term, for the position of Vice Chairman of the Commune People's Committee, Decree 08/2016/ND-CP (Article 7, Chapter II) and the Law on Organization of Local Government 2015 (Articles 34, 62, 69) stipulate: The People's Committees of communes, wards and towns of type 2 and type 3 shall only arrange 1 Vice Chairman. This change will lead to a surplus of people in wards and communes that have arranged 2 Vice Chairmen of the Commune People's Committee according to Decree 107 before.
Through statistics and review, the whole province has 179 wards, communes and towns with "extra" 1 vice chairman who must be rearranged and reassigned according to new regulations.

This is a problem that arises when implementing the new decree and law replacing the old decree, and not only Nghe An but all provinces and cities in the country have to face this surplus reality. The amount of surplus depends on the area, population, and administrative boundaries of each locality and region. Not to mention, even neighboring provinces such as Thanh Hoa province, through statistics and screening, have 161 cadres subject to arrangement and rearrangement according to the Law on Organization of Local Government, Ha Tinh province also has 91 cases in this category...
The purpose of the arrangement, assignment, and rotation of cadres in general, and the position of Vice Chairmen of the People's Committee at the commune level in particular, is to gradually streamline the apparatus, towards improving capacity and perfecting the local government. And the review and statistics of 179 Vice Chairmen of the People's Committee at the commune level subject to streamlining to have a suitable arrangement and rearrangement plan is implemented according to the Law on Organization of Local Government, not "suddenly" discovering "redundancy" or because of previous "redundancy" appointments or appointments against regulations.
Proactively plan appropriate arrangements and re-arrangements
Since the beginning of April 2016, the Department of Home Affairs has issued Official Dispatch No. 470/SNV-XDCQ on the arrangement of commune-level cadres after the Party Congress and the implementation of the Law on Organization of Local Government to districts, cities and towns, requesting localities to base on the Decision on classification of commune-level administrative units of the People's Committee of Nghe An province and the Law on Organization of Local Government to arrange the number of vice chairmen of the People's Committee at the commune level in accordance with regulations.

For communes of type 2 and 3 that have arranged 2 vice chairmen of the commune People's Committee, the People's Committees of districts, cities and towns shall base on Resolution 02-NQ/TU dated March 15, 2016 of the Provincial Party Executive Committee on rotation and transfer of Party members and leaders and managers for the period 2016 - 2020; the actual situation in the locality and training level, working capacity to have a plan to arrange and rearrange cadres.

Based on the actual situation and proposals from localities, the plans for arranging and rotating vice chairmen who need to be downsized are implemented as follows: First, reviewing and evaluating the capacity and qualities of cadres to arrange them into appropriate and equivalent leadership positions such as (secretary, deputy secretary, vice chairman of the People's Council at the commune level...).
Second, for cadres with basic capacity, they can be assigned to positions in district-level departments. The rest will be assigned to positions of commune-level civil servants based on their capacity, experience, strengths and actual needs in the locality.

Third, for the number of cadres who are about to retire, if there is a need, conditions will be created to resolve the regime. In addition, it is possible to consider the option of transferring to other communes in the district if those communes still have vacancies for equivalent positions.
Currently, out of 179 vice chairmen of the People's Committee of the commune that need to be rearranged and reassigned: 125 people are transferred to become commune civil servants, 1 person is promoted to become the secretary of the commune party committee; 5 people are deputy secretaries of the commune party committee, 23 people have plans to be arranged as vice chairmen of the People's Council of the commune, 4 people are retiring, 21 people have plans to be arranged to other positions such as: Chairman of the Women's Union of the commune, the Fatherland Front Committee of the commune, the Farmers' Association... |
Thus, Nghe An's proactively counting and reviewing the number of vice chairmen of commune-level People's Committees to have a plan for rearrangement and reassignment according to the new requirements stipulated in Decree 08 of the Government and the Law on Organization of Local Government in 2015 is completely normal and consistent with reality.
This is also the premise to concretize Resolution No. 39 of the Politburo on streamlining staff and restructuring the team of cadres, civil servants and public employees from now until 2021.
