Nghe An: No social insurance debt business has been sued yet
(Baonghean.vn) - Enterprises with long-term social insurance arrears, not building salary scales, not declaring workers... are issues raised and analyzed at the Conference on implementing the 2018 coordination program between the provincial Social Insurance and the provincial Labor Federation, held on the afternoon of May 25.
At the conference, Mr. Le Truong Giang - Director of the Provincial Social Insurance presented remarkable data: Currently, there are 1,165 enterprises in the province that have not participated in compulsory social insurance. After inspection, 119 enterprises did not cooperate, and more than 500 enterprises are not operating or have changed their headquarters address, making it impossible for Social Insurance officers to contact them!
“This is a painful reality. There are many businesses, but are they actually still operating? And then there are the fact that many businesses do not build salary scales, do not declare their employees… affecting the rights of workers, causing difficulties in implementing social insurance, health insurance, and unemployment insurance policies,” the head of the provincial Social Insurance frankly said.

Sharing the same opinion with Mr. Le Truong Giang, the representative of the Provincial Labor Federation also said that the awareness of complying with the Social Insurance Law of some enterprises is not high. Although the inter-sectoral agencies have focused on establishing inspection teams, the situation of compulsory social insurance debt at enterprises is still complicated, and the rights of employees at units with outstanding debts are affected.
The biggest difficulty currently in handling enterprises that owe social insurance is that although the Penal Code has 3 provisions related to filing lawsuits for violations of social insurance laws, the filing of lawsuits by trade unions as well as the trial of judicial agencies still have many shortcomings, so they have not yet had a deterrent effect.
In 2017, the Social Insurance and the Provincial Labor Federation coordinated to consolidate and complete the lawsuit file against 14 units with outstanding social insurance and health insurance payments in Vinh City, but the City People's Court has not yet handled it.

At the conference, the two units evaluated the results of the implementation of the 2017 joint work program on the following contents: information exchange; propaganda and dissemination of laws; inspection, supervision, settlement of complaints and denunciations; administrative reform. Basically, the contents were actively and proactively coordinated by the leaders, officers and experts of the two units.
Based on that assessment, the Provincial Social Insurance and the Provincial Labor Federation signed a cooperation program for 2018.
