Nghe An: Enforced execution of 62 cases of non-voluntary execution of judgments
(Baonghean.vn) - In less than 1 year (from October 1, 2016 to September 30, 2017), civil enforcement agencies in Nghe An province have applied compulsory enforcement measures to 62 cases, an increase of 32 cases compared to the same period.
In 62 cases of forced execution, 39 forced executions involved the mobilization of inter-sectoral forces, an increase of 26 cases compared to 2016. In general, the construction of forced execution records was strict and in accordance with legal regulations. The coordination of forces between functional agencies and local authorities was timely. Thanks to that, forced executions were carried out safely and effectively.
However, according to the leader of the Department of Professional Affairs and Enforcement Organization (Civil Enforcement Department of the province), the application of enforcement measures encountered some difficulties such as: some cases where the person subject to enforcement was not present at the enforcement session or the seized property was being held by a third party, causing difficulties in handing over the property for safekeeping.

The seizure of production lines and machinery for business has encountered difficulties in valuation and hiring of custodians. Some banks have not been strict in the process of appraising mortgaged assets for lending, there have been errors, and overlapping areas have led to prolonged execution of judgments.
In some cases, the person executing the sentence is serving a prison sentence and the specific assets shared with the family have not been determined, with 759 cases/50 billion VND.
In addition, citizens' awareness of law enforcement is not high. Many cases do not cooperate and even use insulting words and actions towards officers and enforcement officers... causing difficulties in the enforcement of judgments.
| Regarding the results of handling assets to ensure enforcement of judgments: the number of cases where assets have been seized, re-evaluated and auctioned many times but have not been processed (as of the end of September 2017), the whole province has 110 cases, corresponding to the amount of 73,154,773,000 VND (an increase of 50 cases/22,318,394,000 VND compared to 2016). Most of which have been auctioned for the 3rd time or more. |
