Nghe An: Resolutely withdrawing suspended projects, projects behind schedule, projects violating investment laws, and projects using land for the wrong purpose
(Baonghean.vn) - This is one of the contents that Nghe An Provincial People's Committee requested relevant departments and branches to strengthen state management of suspended projects, slow-progress projects and projects using land for the wrong purpose in the province.
Pursuant to Resolution No. 31/NQ-HDND dated July 14, 2022 of the Provincial People's Council on strengthening state management of suspended projects, slow-progress projects and projects using land for the wrong purpose in Nghe An province, Nghe An Provincial People's Committee issued Document No. 6680/UBND-CN, assigning provincial departments, branches and People's Committees of districts, cities and towns to focus on implementing the following contents:
I. General tasks
1. Strictly implement legal regulations on management and supervision of investment projects in the province.
2. Improve the responsibility and quality of appraisal of investment policies for projects using land in the province. Especially the appraisal of financial capacity and experience of investors; do not consider approving new projects for investors who violate land law regulations; strictly implement legal regulations on procedures and forms of selecting investors to implement projects.
3. Improve the quality of construction planning appraisal and construction planning adjustment appraisal, ensuring compliance with standards, regulations and laws on construction planning; project adjustment, conversion of land use purpose from land for lease for production and business to residential land (dividing plots for sale, building apartment buildings...) must comply with current laws.
4. Regularly disseminate legal regulations on investment, land, construction, and planning to investors of projects using land in the province.

II. Specific tasks
1. The Department of Planning and Investment shall preside over and coordinate with relevant departments, branches and localities to implement:
- Complete the investment project management software in the province to monitor and update project information, serving state management in the investment sector in general and land use projects in particular.
- Review and synthesize overlapping and inadequate contents in leadership and direction documents on management and implementation of investment projects using land to promptly amend and supplement and recommend competent authorities to amend, supplement or issue new ones to ensure consistency, unity and convenience in the implementation process.
- Focus on attracting infrastructure investment projects in the Southeast Economic Zone, industrial parks and industrial clusters; at the same time, focus on attracting capable, experienced and reputable investors to invest in industrial parks and industrial clusters.
- Review and classify slow-progressing projects outside economic zones and industrial parks to advise on solutions and policies to remove difficulties and obstacles for slow-progressing projects due to objective reasons, especially in compensation and site clearance. Conduct inspections, handle and recommend handling of slow-progressing projects outside economic zones and industrial parks; re-inspect projects that have been inspected and allowed to extend progress but have not been completed; strictly handle suspended projects, projects that have been slow for many years, projects that violate investment laws, are built in violation of planning, and use land for purposes other than those prescribed by law.
- Advise the Provincial People's Committee to report to the Provincial People's Council on the results of reviewing, inspecting and handling projects that are behind schedule and using land for the wrong purpose in the province at the regular meeting of the Provincial People's Council at the end of the year.
- Advise the Standing Committee of the Provincial Party Committee to issue a Resolution on strengthening the Party's leadership over investment projects using land in Nghe An province (focusing on managing, inspecting, supervising, and handling non-budgetary capital projects that use land slowly or use land for the wrong purpose).
- Preside over and review the implementation of inspection conclusions for projects chaired by the agency in Appendix 3 - Report No. 156/BC-ĐGS.HĐND dated July 6, 2022 of the Provincial People's Council Supervision Delegation.
- Implement the contents recommended by the Provincial People's Council Supervision Delegation in Report No. 156/BC-DGS.HĐND dated July 6, 2022.
2. Department of Construction
- Preside over and coordinate with relevant departments, sectors and localities to perform state management functions in the fields of housing, real estate business and construction planning management. Regularly inspect and examine to detect and handle violations in the assigned sectors and fields.
- Coordinate with the Department of Planning and Investment in reviewing, inspecting and handling slow-progressing projects.
- Preside over and review the implementation of inspection conclusions for projects chaired by the agency in Appendix 3 - Report No. 156/BC-ĐGS.HĐND dated July 6, 2022 of the Provincial People's Council Supervision Delegation.
- Implement the contents recommended by the Provincial People's Council Supervision Delegation in Report No. 156/BC-DGS.HĐND dated July 6, 2022.
3. Department of Natural Resources and Environment
- Preside over and coordinate with relevant departments, sectors and localities to perform state management functions in the fields of land, environmental protection and mineral exploitation. Regularly inspect and examine to detect and handle violations in the sectors and fields assigned to manage.
- Coordinate with the Department of Planning and Investment in reviewing, inspecting and handling slow-progressing projects.
- Implement the contents recommended by the Provincial People's Council Supervision Delegation in Report No. 156/BC-DGS.HĐND dated July 6, 2022.
- Preside over and review the implementation of inspection conclusions for projects chaired by the Department in Appendix 3 - Report No. 156/BC-ĐGS.HĐND dated July 6, 2022 of the Provincial People's Council Supervision Delegation.
4. Southeast Economic Zone Management Board
- Review and classify slow-progressing projects in economic zones and industrial parks to advise on solutions and policies to remove difficulties and obstacles for slow-progressing projects due to objective reasons, especially in compensation and site clearance. Conduct inspections, handle and recommend handling of slow-progressing projects in economic zones and industrial parks. Monitor and urge projects with adjusted progress; re-inspect projects that have been inspected and allowed to extend progress but have not been completed. Resolutely revoke suspended projects, projects that have been slow for many years, projects that violate investment, planning, construction laws, use land for improper purposes, and violate environmental laws.
- Implement the contents recommended by the Provincial People's Council Supervision Delegation in Report No. 156/BC-DGS.HĐND dated July 6, 2022.
- Preside over and review the implementation of the inspection conclusions for projects presided over by the Inspection Committee in Appendix 3 - Report No. 156/BC-ĐGS.HĐND dated July 6, 2022 of the Provincial People's Council Supervision Delegation.
5. Provincial Tax Department
- Timely implement coercive measures against investors who have prolonged land use debt; strengthen inspection and examination of investors whose projects have been allocated land or leased land in the province.
- Proactively recommend the Departments of Planning and Investment, Natural Resources and Environment, Construction and the Southeast Economic Zone Management Board... to inspect, examine and promptly handle projects with long-term financial obligations, recommend not to approve new project investment policies for investors who still owe state financial obligations during the process of coordinating consultation on project investment policy approval.
6. People's Committees of districts, cities and towns
- Responsible for monitoring and urging the progress of investment projects in the area; promptly handling or reporting, recommending handling of cases of law violations.
- Actively coordinate implementation and remove difficulties for investors in compensation and site clearance.
- Monitor and urge projects that have been inspected and are under extension to be implemented on schedule (in Appendix 1 - Report No. 156/BC-ĐGS.HĐND dated July 6, 2022 of the Provincial People's Council Supervision Delegation).
- Review, report, and recommend inspections of projects that have been inspected, have expired the extension period but have not been completed in Appendix 2 - Report No. 156/BC-ĐGS.HĐND dated July 6, 2022 of the Provincial People's Council Supervision Delegation.
Requesting Directors of Departments, heads of branches, Chairmen of People's Committees of districts, towns and cities; heads of agencies, units and related organizations and individuals to seriously implement./.
