Nghe An: Received over 6,000 citizens coming to complain and denounce

At the regular meeting of the Provincial People's Committee in November 2018, Mr. Vi Van Suu - Chief Inspector of the province said that the situation of complaints and denunciations focused mainly on the land sector.

Of which, the provincial citizen reception office received 646 visits, down 26.2%; provincial departments, branches and sectors received 357 visits, up 49.3%; districts and communes received 5,018 visits, down 9.5%.

The total number of complaints, denunciations, petitions, reflections, and land disputes arising in the province in 2018 was 7,267, down 4.9% over the same period in 2017.

In 2018, the whole province resolved: 213/223 complaints arising under its jurisdiction, reaching a rate of 95.5%. Through resolving complaints, it was shown that: The number of correct complaints was 24/213 cases, accounting for 11.3%; the number of complaints with correct or incorrect answers was 56/213 cases, accounting for 26.3%; the number of incorrect complaints was 133/213 cases, accounting for 62.4%.

Through the settlement of complaints and denunciations, violations were discovered and recommendations were made to recover 4,694 million VND and 14,410m²land, return to citizens 140 million VND and 650 m²Land. Recovered 1,073 million VND to the state budget, returned 3.38 million VND to citizens.

Proposed competent authorities to administratively discipline 19 individuals who committed violations, handled 12 individuals, protected the rights of 82 people. Transferred 2 cases to the investigation agency.

According to Mr. Vi Van Suu - Chief Inspector of the province, the main reasons leading to complaints and denunciations are: The mechanism and policies related to the rights of land users are still inadequate, inappropriate and inconsistent; The law does not have specific instructions on handling cases of false complaints and denunciations; There are no sanctions prescribed for complaints and denunciations that administrative agencies at all levels have resolved beyond their authority, requiring citizens to file lawsuits in court.

Legal awareness of some officials and civil servants in performing the task of handling complaints and denunciations still has limitations, especially in determining the content of the petition, the authority to handle and resolve, so there have been some cases where the resolution has not ensured the content of the citizen's petition.

In addition, some citizens do not clearly understand the provisions of the law, the rights and obligations of complainants and denouncers, so in reality, the situation of making false complaints and denunciations, or complaints and denunciations that are both right and wrong, is still quite common and accounts for a fairly high rate. In particular, there are some cases where the content of the petition has been resolved and responded to in accordance with the provisions of the law by authorities and sectors, but they still deliberately continue to complain to complicate the situation.
