Low implementation rate
According to the report, the results of the implementation of the list of works, projects, and areasland acquisition, land use conversion for construction and project implementation in the province is still low in terms of both the number of constructions, projects and the area recovered and converted.
There are still many projects and works that need to be recovered and have their land use purposes changed but have not been implemented, cannot be implemented, have been cancelled, or have passed the deadline for transfer.
Specifically, the period 2016 - 2021,Provincial People's CouncilIssued 15 resolutions on land recovery according to regulations in Clause 3, Article 62 of the Land Law. Through monitoring, it shows that the results of land recovery of 2,446/5,789 works and projects (reaching 42.25%) with a total area of 4,802.4/15,491.34 hectares (reaching 31%).
Also during this period, the Provincial People's Council issued 16 resolutions on changing the purpose of using rice-growing land, protective forest land, and special-use forest land according to the provisions of Clause 1, Article 58 of the Land Law to implement works and projects in the province.
The results have been 1,298/3,389 projects and works (38.3%) implemented; 1,404.54/3,862.55 hectares of rice land have been converted to other uses (36.36%); 190.71/343.56 hectares of protective forest land have been converted (55.5%) and 4.47/5.57 hectares of special-use forest land have been converted (80.25%).

Proposing 7 groups of tasks and solutions
To improve the effectiveness and efficiency of implementing the Provincial People's Council's resolutions on land recovery and land use conversion in the province in the coming time, the report also makes 7 proposals and recommendations to the Provincial People's Committee.
The Provincial People's Committee needs to direct departments, branches and localities to review and integrate land use planning into the Provincial Planning for the 2021-2030 period, with a vision to 2050, on that basis, develop annual land use planning and plans to ensure quality and feasibility.
It is recommended to balance the allocation of increased annual funding to accelerate the progress of cadastral surveying of agricultural land after "land consolidation" and forestry land, land registration, certification, and construction of land databases in the province according to Directive No. 01/CT-TTg dated January 3, 2018 of the Prime Minister.
Review documents of the Central and the province to promptly amend, supplement, and replace, ensuring compliance with legal regulations and good management of land resources such as: issuing documents to direct and rectify the implementation of land use rights auction projects across the province to limit waste of land resources; regulating the increase of the percentage (%) of deposits in land use rights auctions; adjusting compensation and site clearance policies for land users when their land is recovered.

Direct departments, branches and localities to strengthen coordination and closely appraise investment projects, especially the appraisal of the capacity of investors; for works and investment projects requiring land recovery and conversion of land use purposes, it is necessary to ensure full compliance with the conditions prescribed by law and the land use area requirement must be appropriate to the scale of the project and in line with the socio-economic development plan of each locality.
Direct the use of Nghe An Provincial Land Development Fund for local units to advance capital to carry out compensation and site clearance work according to the compensation and site clearance plan approved by competent authorities.
Strengthening the inspection and examination of land recovery and land use conversion to implement projects in accordance with regulations. For projects that have not been implemented due to objective reasons, there must be solutions to remove difficulties and obstacles for implementation; for projects that have not been implemented for a long time due to subjective reasons (weak financial capacity of investors for non-budget investment projects; inability to arrange capital for projects using state budget capital...), it is necessary to resolutely recover and cancel them to avoid leaving them abandoned and wasting land resources.
Direct relevant departments, branches and units to resolve difficulties in compensation and site clearance for the mine area of the Song Lam II Cement Factory Expansion Planning Project (Phase 2) in Yen Thanh District; and the re-production of people in Area A - Nam Cam Industrial Park, Nghi Loc District.
