Listen and give opinions on the results of reviewing and systematizing legal documents issued by the Provincial People's Committee.
(Baonghean.vn) - On the morning of January 22, the Provincial People's Committee held a meeting to listen to and give opinions on the results of reviewing and systematizing legal documents issued by the Provincial People's Committee in the period 2019-2023.
According to Article 164 of Decree No. 34/2016/ND-CP (amended and supplemented by Clause 38, Article 1 of Decree No. 154/2020/ND-CP), legal documents must be periodically systematized and the systematization results must be published every 5 years.
On that basis, on February 17, 2023, the Government Office issued Official Dispatch No. 969 on the systematization of legal documents; the Ministry of Justice issued an official dispatch guiding the development of a plan and implementation of the systematization of documents for the period 2019 - 2023.

Regarding Nghe An province, on January 31, 2023, the Provincial People's Committee issued Plan No. 48, in which it determined to review and systematize legal documents for the period 2019 - 2023.
According to comrade Hoang Thi Thu Trang - Member of the Provincial Party Committee, Director of the Department of Justice: The review and systematization of legal documents (QPPL) helps competent authorities identify and classify the system of lists of legal documents that are still legally effective; lists of legal documents that have partially expired; lists of legal documents that have completely expired and lists of legal documents that need to be amended, supplemented, abolished or replaced. At the same time, the systematization of legal documents that are still legally effective aims to ensure legality and consistency with the current system of documents.
Thereby, creating favorable conditions for people to look up and learn about the law as well as serving the State management work of competent agencies.

According to the results of the review and systematization of legal documents in the period of 2019 - 2023 issued by the People's Committee of Nghe An province, there are 496 documents still in effect, 392 documents have completely expired; 57 documents have partially expired; 99 documents need to be amended, supplemented, replaced, or abolished.
The Department of Justice has compiled a list of legal documents issued by the Provincial People's Committee in the period of 2019 - 2023 according to each field group. After 3 times of collecting opinions from departments, branches, sectors and localities, the Department of Justice has compiled 4 lists and completed the draft Decision on the results of reviewing and systematizing legal decisions and directives issued by the Nghe An Provincial People's Committee in the period of 2019 - 2023.

At the conference, the Department of Justice also submitted to the Provincial People's Committee for consideration and issuance of a Decision to abolish all 52 documents (including 32 decisions and 18 directives issued by the People's Committee of Nghe An province) and partially abolish 1 decision, specifically Article 13 of Decision No. 12/2015/QD-UBND dated January 30, 2015 promulgating regulations on the management of licensing for exploration, exploitation, use of water resources, discharge of wastewater into water sources and practice of underground water drilling in Nghe An province.
Discussing at the meeting, representatives of leaders of departments and branches contributed opinions, basically agreeing with the draft proposal to abolish and replace a number of decisions and directives on planning in areas that are no longer suitable to practical conditions.

Speaking at the meeting, comrade Le Hong Vinh - Member of the Provincial Party Committee, Permanent Vice Chairman of the Provincial People's Committee emphasized the review of legal documents issued by the Provincial People's Committee in the period of 2019-2023 to systematize which documents are still valid during the direction and administration process, avoiding documents that have expired, documents that are valid from higher levels that have been issued but the province still implements against the provisions of the law or when implementing in practice, encountering difficulties and obstacles.

Standing Vice Chairman of the Provincial People's Committee Le Hong Vinh requested relevant departments and branches to continue to carefully review and provide written comments for the Department of Justice to synthesize and submit to the Provincial People's Committee; especially for the document of partial repeal.
At the same time, it is important to note that the review and systematization must ensure accuracy, consistency and uniformity; the amendment, supplementation, abolition and replacement of legal documents must have a legal and practical basis, paying attention to the transitional nature of the abolished, replaced, amended and supplemented regulations to ensure proper order and procedures.
