RESOLUTION

ORGANIZATION FOR GATHERING PUBLIC OPINION
REGARDING THE 1992 DRAFT AMENDMENT TO THE CONSTITUTION



NATIONAL ASSEMBLY

SOCIALIST REPUBLIC OF VIETNAM

Based on the Constitution of the Socialist Republic of Vietnam of 1992, as amended and supplemented by Resolution No. 51/2001/QH10;

Based on Resolution No. 06/2011/QH13 dated August 6, 2011, of the National Assembly on amending and supplementing the 1992 Constitution and establishing the Committee for drafting amendments to the 1992 Constitution;

After considering Report No. 195/TTr-UBDTSĐHP dated October 19, 2012, from the Committee for Drafting Amendments to the 1992 Constitution and the opinions of the National Assembly deputies,

RESOLUTION:

Article 1. Organizing public consultations on the draft amendments to the 1992 Constitution.

The draft amendments to the 1992 Constitution, which were revised based on feedback from National Assembly deputies at the 4th session of the 13th National Assembly, were announced by the Committee for Drafting Amendments to the 1992 Constitution.

Article 2. Purpose of organizing public consultations

1. Promote the people's right to self-governance, mobilize the people's intellect and dedication, create public consensus, and express the people's will and aspirations in amending the 1992 Constitution.

2. To raise awareness and responsibility of each individual, agency, and organization regarding the amendment and implementation of the Constitution.

Article 3. Requirements for organizing public consultations

1. Organize discussions and gather public opinions through appropriate forms, creating favorable conditions for all segments of the population in the country and Vietnamese people residing abroad to participate in amending the 1992 Constitution. The process of gathering public opinions must be conducted widely, democratically, scientifically, and transparently; ensuring timeliness, quality, practicality, and cost-effectiveness.
2. Public opinions and contributions must be fully and accurately collected and synthesized, and seriously studied, considered, and explained in order to finalize the draft amendments to the 1992 Constitution.
3. Enhance the responsibility of news agencies and the press in disseminating information, mobilizing the public to contribute opinions, and truthfully and promptly reflecting the opinions of the people; preventing malicious individuals and hostile forces from exploiting and distorting the Party's policies and guidelines and the State's laws to undermine and disrupt the Party.

4. Ensure the leadership of Party committees at all levels, the close guidance of government agencies at all levels, and emphasize the responsibility of heads of agencies and organizations in soliciting public opinion on the draft amendments to the 1992 Constitution.

Article 4. Content and form of soliciting public opinion

1. Gather public opinion on the entire draft amendment to the 1992 Constitution, including: the Preamble; the political system; human rights, fundamental rights and obligations of citizens; economy, society, culture, education, science, technology and environment; national defense; the state apparatus; the effectiveness of the Constitution and the constitutional amendment process; and the technical presentation of constitutional provisions.

2. Agencies, organizations, and individuals participating in providing feedback on the entire Draft Amendment to the 1992 Constitution should, based on their functions, duties, and powers, focus their contributions on in-depth opinions regarding issues directly related to the scope of their activities and matters of concern to them.

3. Forms of soliciting public opinion include:

a) Provide feedback directly or in writing to the agencies and organizations specified in Article 6 of this Resolution;

b) Discussions at conferences, seminars, and forums;

c) Through the National Assembly's website http://duthaoonline.quochoi.vn and other mass media;

d) Other suitable forms.

Article 5. Subjects for consultation

1. The various social classes.

2. Central government agencies and organizations: Standing Committee of the National Assembly, National Council, Committees of the National Assembly, agencies of the Standing Committee of the National Assembly; Government, ministries, ministerial-level agencies, agencies under the Government; Supreme People's Court; Supreme People's Procuracy; State Audit Office; Party Committees; Central Party Office, Office of the President.

3. Local government agencies: People's Council, People's Committee, People's Court, People's Procuracy.

4. The Vietnam Fatherland Front, political and social organizations, political and social-professional organizations, social-professional organizations, and other social organizations.

5. Academies, universities, and research institutes.

6. News agencies and media outlets.

Article 6. Responsibilities of agencies, organizations and their heads

1. Based on this Resolution, the Committee for Drafting Amendments to the 1992 Constitution is responsible for issuing a plan for organizing public consultations; presiding over the organization of public consultations; organizing conferences to gather public opinions, ensuring the content, materials, and training of staff; compiling and submitting to the National Assembly a summary report of public opinions; studying, incorporating, and explaining the contributions of the people to revise and finalize the draft amendments to the 1992 Constitution for submission to the National Assembly for consideration and decision.

2. The Standing Committee of the National Assembly directs the agencies of the National Assembly and the agencies of the Standing Committee of the National Assembly to organize discussions, gather opinions, and synthesize opinions, and to prepare a report on the results of the opinions contributed by the Standing Committee of the National Assembly, the agencies of the National Assembly, and the agencies of the Standing Committee of the National Assembly, to be submitted to the Committee drafting amendments to the 1992 Constitution.

3. The Government directs ministries, ministerial-level agencies, and government agencies to organize discussions, gather opinions, and synthesize feedback, and to prepare a report on the results of feedback from the Government, ministries, ministerial-level agencies, government agencies, and centrally-administered provinces and cities, to be submitted to the Committee for Drafting Amendments to the 1992 Constitution.

4. The Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, the Party Committees, the Central Party Office, and the Office of the President shall organize discussions, gather opinions, and prepare reports on the results of their respective contributions to the Committee for Drafting Amendments to the 1992 Constitution.

5. The People's Councils of provinces and centrally-administered cities shall organize specialized meetings to discuss the Draft Amendments to the 1992 Constitution. The Standing Committee of the People's Council of the province or centrally-administered city shall preside over and coordinate with the People's Committee, the National Assembly Delegation, the Fatherland Front Committee and its member organizations at the same level to organize discussions, gather opinions, and synthesize opinions, and prepare a report on the results of the local contributions to the Government and the Committee for Drafting Amendments to the 1992 Constitution.

6. The Vietnam Fatherland Front and its member organizations are responsible for mobilizing the people to contribute opinions on the Draft Amendment to the 1992 Constitution. The Central Committee of the Vietnam Fatherland Front, in coordination with the central agencies of its member organizations, shall organize discussions, gather opinions from its members, other social organizations, and representatives from prominent intellectuals, lawyers, religious groups, and overseas Vietnamese. The Committee shall then synthesize these opinions and prepare a report on the results of the feedback to be submitted to the Committee for Drafting Amendments to the 1992 Constitution.

7. Political and social organizations shall organize discussions, gather opinions, and synthesize those opinions, preparing a report on the results of their contributions to the Committee drafting the amendments to the 1992 Constitution.

8. National Assembly delegations and National Assembly deputies shall collect and study the opinions and contributions of voters in preparation for the discussion and adoption of the Constitution at the National Assembly session.

9. News agencies and press organizations are responsible for disseminating information and creating favorable conditions for the public to participate in contributing opinions; opening special pages and sections on the Draft Amendment to the 1992 Constitution and reporting and publishing the public's opinions fully, promptly, truthfully, and objectively.

10. Other agencies, organizations, and individuals may submit written comments to the Committee drafting amendments to the 1992 Constitution.

11. The heads of agencies and organizations specified in this Article are responsible for organizing and creating favorable conditions for officials, civil servants, employees, and workers within their agencies and organizations, as well as all segments of the population, to participate in providing feedback on the Draft Amendments to the 1992 Constitution.

Article 7. Timeframe for soliciting public opinion

The period for soliciting public opinion on the draft amendments to the 1992 Constitution began on January 2, 2013, and ended on March 31, 2013.

Article 8. Implementation

1. The Committee for Drafting Amendments to the 1992 Constitution, and relevant agencies and organizations, based on this Resolution, the Plan for Organizing Public Consultation of the Committee for Drafting Amendments to the 1992 Constitution, and the specific circumstances of their respective agencies, organizations, and localities, shall implement the consultation process to ensure that the requirements and timelines are met.

2. The funding for organizing public consultations on the draft amendments to the 1992 Constitution is guaranteed by the state budget.

3. The National Assembly calls upon all compatriots, soldiers nationwide, and Vietnamese people residing abroad to respond and actively participate in contributing opinions so that the Constitution fully reflects the will and aspirations of the people, meeting the requirements of building, developing, and protecting the Fatherland in the new era.

This resolution was adopted by the 13th National Assembly of the Socialist Republic of Vietnam, at its 4th session, on November 23, 2012.
