Ms. NTV (residing in Vinh City) told Nghe An Newspaper that when she was preparing documents for her child to go to school, she discovered that the original birth certificate was lost. Because the school the child intended to take the exam at required checking the original birth certificate, she went to the local ward to request a new one.
However, the ward judicial and civil status officer replied, “The new civil status law only regulates re-registration of birth certificates, but does not regulate the re-issuance of original birth certificates. In your child’s case, the ward People’s Committee has kept full information, so it will only re-issue a copy of the birth certificate…”

Ms. NTV said: “I looked it up online and saw that some media outlets reported that they still allowed reissuance of original birth certificates. I don’t understand why Nghe An doesn’t do it. The school my child is planning to take the exam has such a rule, now we know how to complete the application for my child…”.
Upon learning from the People's Committee of the ward where Ms. NTV resides, the judicial and civil status officer confirmed the incident and explained that the failure to reissue the birth certificate was in compliance with the provisions of the 2015 Law on Civil Status, which took effect in January 2016.
This judicial and civil status officer explained: “Previously, the reissuance of original birth certificates was carried out according to Decree 158. Decree 158 has a section clearly regulating the reissuance of original birth certificates. When the 2015 Civil Status Law and Decree 123 were issued and took effect, the section on reissuance of original birth certificates no longer existed. Through training on the implementation of the new law, we were instructed by our superiors to stop reissuing original birth certificates. Therefore, the ward no longer does it…”.
Meanwhile, the Chairman of the Ward People's Committee wondered: "In our area, not only Ms. NTV has the need to reissue the original birth certificate. I think that any family can lose documents, when the need arises, we should create conditions to reissue them to the people. But in reality, there is no problem with reissuing the original birth certificate. The original data is now stored well by the ward and commune, there are no errors. The new law also needs to be studied closely in practice to create more convenience for the people, right?"
