In what cases will drivers of commercial vehicles transporting students be punished?

Article 27Decree 168/2024/ND-CPregulations onPenalties and deduction of points from the driving license of drivers of commercial vehicles transporting preschool children and students, and commercial vehicles transporting children and students in combination with activities of picking up and dropping off preschool children and studentsas follows:

1. A fine of VND 1,000,000 to VND 2,000,000 shall be imposed on drivers of commercial vehicles transporting preschool children and students, or commercial vehicles transporting children and students in combination with activities of picking up and dropping off preschool children and students who commit one of the following violations:

a) Not instructing preschool children and students to sit in the correct position in the vehicle;

b) Driving a commercial vehicle transporting preschool children, primary school students, or a commercial vehicle transporting children in combination with the activities of picking up and dropping off preschool children, primary school students without age-appropriate seat belts or without age-appropriate seats as prescribed;

c) Driving a vehicle without a driver image recording device installed or with a driver image recording device installed but it is not effective during the vehicle's participation in traffic as prescribed or distorting the data of the driver image recording device installed on the vehicle.

2. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed on the act of driving a commercial vehicle transporting preschool children, primary school students, or a commercial vehicle transporting children and primary school students without or without enough managers on each vehicle as prescribed in Clause 3, Article 46 of the Law on Road Traffic Order and Safety.

3. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed on drivers of commercial vehicles transporting preschool children and students, or commercial vehicles transporting children and students in combination with activities of picking up and dropping off preschool children and students who commit one of the following violations:

a) Driving a vehicle without a journey monitoring device or having a journey monitoring device installed but it is not effective during the vehicle's participation in traffic as prescribed or falsifying data of the journey monitoring device installed on the car;

b) Driving a vehicle without a device to record images of preschool children or students or without a device with a warning function to prevent children from being left in the vehicle or without a device to record images of preschool children or students and a device with a warning function to prevent children from being left in the vehicle;

c) Driving a commercial vehicle transporting preschool children or students without the prescribed paint color;

d) Driving a commercial vehicle transporting preschool children and students, or a commercial vehicle transporting children and students in combination with the activities of picking up and dropping off preschool children and students without a sign identifying it as a vehicle transporting preschool children and students as prescribed.

4. In addition to being subject to penalties, drivers who commit the acts specified in Clause 2 and Clause 3 of this Article shall have their driving license deducted 2 points.
